BLM Still Harassing Jeanette Finicum...

Rather than allow Jeanette to take over the grazing allotments after LaVoy's Death, State BLM representatives said she was not considered heir to the allotments, even though she was the widow of one. They told her the grazing permits terminated upon his death and that she would have to start over at square one with the application process to graze her (their) cattle on the allotment.

I don't remember seeing this posted back in December. It came to my attention at the AzGOP meeting yesterday when I was told by my State Senator that the Legislature is holding a hearing on Friday morning, Feb. 3 about this matter. Jeanette Finicum will be speaking. When I receive conformation of the time and location, I will post it to this thread. If it is held in one of the hearing rooms, it should be available to watch. Please read the entire article and consider watching or attending the hearing. I am going to try to attend but may not be able to make it up to Phoenix.

There may be help for Mrs. Finicum in an Executive Order President Trump recently signed. What I am posting regards both Obamacare and actions taken by Federal Bureaucrats against citizens. The bold and underlined part might apply to Mrs. Finicum. This is Judge Napolitano's view:

"regulations already in place be enforced with a softer, more beneficent tone, and he ordered that no penalty, fine, setoff or tax be imposed by the IRS on any person or entity who is not complying with the individual mandate, because by the time taxes are due on April 15, the IRS will be without authority to impose or collect the non-tax tax, as the individual mandate will no longer exist. Why take money from people that will soon be returned?

I agree. If the BLM follows the instructions of the EO, it should allow Mrs. Finicum to graze the cattle while she pursues the application process, at minimum, because cutting off her ability to graze her cattle on the allotments would be unduly severe.

They have already violated their own regulations.

According to the article, “Jeanette’s attorney advised her that under BLM rule 43 CFR 4110.2-3, the BLM is required to provide her two years to meet any paperwork requirements, and must allow her to continue to graze her cattle during those two years. Jeanette said she and her attorneys brought this law to the attention of BLM representatives and were told, “we don’t do it that way.”

We can hope they obey the EO but I have the feeling the BLM will have to be made to comply.

It's exactly because of this attitude by bullying bureaucrats that President Trump issued the EO. I hope for the sake of Mrs. Finicum that in the near future the BLM will get the message loud and clear.
