If Schumer can delay until May I heard, the court will likely tie on several big cases like transgendered bathrooms and EPA rules and those will remain law. Gorsuch needs to be confirmed quickly.
“Unfortunately, McCain, Graham, Collins, and Rubio wont go for the nuclear option”
Don’t be so sure. You ignore the persuasive power of our new president.
Second, this is the only chance in a lifetime for Republicans to stack the courts.
“Nuke option now and later.., if the Democrats ever get back in power they will use it anyhow first chance they get. “
Yep. Harry Reid said as much when he was sure hillary was going to win. We will never really know what a bullet we dodged in November.
But Schummers goal is to delay his appointment until April when the supreme court makes it decisions on cases they will hear,if the make up of the court is still 4-4,the decisions then go back to the lower court.
There are decisions on abortion I believe, and others that have been ruled in the lower courts favorable to Schummer,so he would love to have them revert back in their favor.
So a tactic that could last six months would suit him fine
But there will be consequences. Some in 2018, some in 2020
Only if Trump gets on the voter fraud problem. #1 priority!

Besides which, I heard it reported on FBN this morning that 7 democrat Senators have already said they're willing to allow a vote. We only need 8 to avoid this stupid dog and pony show.
The rats can only hold out for so long. This is going to hurt them bigly and sooner or later that will occur to some of their more astute members.

ALEXANDRIA, Va. The Judicial Crisis Network (JCN) today announced plans for a national campaign to confirm President Trumps nominee to the Supreme Court. Coming off of its historic Let the People Decide victory in the Garland nomination battle, JCN will engage a comprehensive campaign of paid advertising, earned media, research, grassroots activity, and a coalition enterprise, all adding up to the most robust operation in the history of confirmation battles. JCN and its allies will focus on states where Senate Democrats are vulnerable in 2018, particularly those where Trump won by large margins. JCN spent more than $7 million in its Let the People Decide effort, and it expects to spend at least $10 million to confirm the next justice.
We are preparing to launch the most robust campaign for a Supreme Court nominee in history and we will force vulnerable Senators up for re-election in 2018 like Joe Donnelly and Claire McCaskill to decide between keeping their Senate seats or following Chuck Schumers liberal, obstructionist agenda, said Carrie Severino, Chief Counsel and Policy Director of the Judicial Crisis Network.
Any vulnerable Senator who signs up for Schumers obstructionist strategy will pay a heavy price in 2018. Exit polls showed that over one fifth of voters said the Supreme Court was a primary reason for their vote and of that large percentage of Americans, Trump won those voters by a resounding 57-40 margin. And he won some of those states by overwhelming margins. The President-elect clearly has a mandate when it comes to the Supreme Court and this effort will ensure that the will of the people prevails, Severino continued.
“Perhaps each one could speak longer, but I doubt it. Based on Pat Leahy’s sad performance today just speaking for 15 minutes, I doubt he could last an hour on the floor (and they must stand, I believe). “
I agree, and will add that Republicans should not permit the modern version of “virtual filibuster”, where a threat is made but no one stands and speaks. Stand up, speak for days or shut up and move on.
Let it go on for a few days while true American’s blood begins to boil and they bring the heat on the obstructionist loosers, it’s going to leave a bigger mark. Their phones are already melting.
Swing away Merrill... SWING AWAY!
All the more reason to force a vote ASAP.
Vice presidents hve been known to have a broad interpretation of “speeches” — sometimes, asking a question has been counted as a “speech” under Rule XIX.
Possibly 4. Breyer is no spring chicken either.
30 years from today, Gorsuch will be younger than Ginsburg is today.
I don’t expect much from the Republican “leadership”, but they know this is the one thing their base insists on. They’ll fight this fight, not for the constitution, not for Trump, not for Gorsuch, but for their own self-preservation.
If you can force a vote without using the nuclear option, it looks more “reasonable” and you can use the nuclear option on the second nomination, claiming they forced you into it.
It’s just a tactical decision.
Democrats from red states.
You could persuade them, and some Democrats are already saying, that this nomination merely restores the status quo ante. It’s the next one that is a game changer.
This is much more simple that it’s being made out to be.
The problem is not the Senate rules that permit unlimited debate (the “filibuster”). The problem is the new practice of allowing a minority to “announce” a filibuster without having to hold the floor.
Under this completely novel practice, the majority agrees to move on to other business WITHOUT the minority having to speak as long as they can hold the floor.
I don’t care if they debate the Gorsuch nomination for a week - as long as they speak for 168 continuous hours.
The Constitution gives each house the power to set its own rules.
I have to say that I am impressed that they strapped on their scrotums today and approved the nominees without the crybaby dems.
Great move!
