This is kinda how I read the case as well. They didn’t stop him for the arms they stopped him for a traffic related issue and disarmed him while investigating it. Then discovered that he was a felon and not able to possess it.

What I have an issue with is that I’ve heard some departments will not return the weapon if no issues are discovered once the stop is completed. THAT in my opinion is a “taking” in the legal sense of the words and a violation of rights.

That I believe would be the author of this articles opinion also as he talks about a transient barring of your second amendment rights. I would think that from everything I'm reading about Judge Gorsuch, he would agree also.

I see the NRA has endorsed him; what is your opinion?

Having seen numerous videos where a simple traffic stop fast escalates into a shootout, I’m not sure I’d want to deny police the power to _briefly_ disarm a suspect if they felt any honest reason to do so. That said, police should also be cognizant that undue disarming does escalate tensions, and even if nothing goes wrong he’s now trying to juggle not just a simple traffic infraction but also physically handling a locked-and-loaded weapon is itself a safety concern (hands already preoccupied with things, no place to set/store it, NDs only happen when someone is handling a gun).

There’s rarely a reason to disarm someone during a mundane stop for a minor infraction, but let’s not overreact by denying police the power to do so when “spidey sense is tingling” (which I’ve very much learned to listen to).

This case certainly is not a reason to refuse Gorsuch. He made a point of minimizing the alleged suspension of rights, and doing so when there was soon found justification for doing so.

Looks like you're "hearing voices", too. I have a little voice that sometimes tells me strongly to do or not to do something. I've been right every time I comply with it and have been badly burned when I've not listened to it.

In both cases the person stopped was found to be in unlawful possession of a gun and was ultimately arrested.

How do you unlawfully possess a firearm in a vehicle? Unless he was out on some kind of prison breakout?
