Amtrak engineer in fatal 2015 Philadelphia crash won’t be criminally charged (No Criminal Intent)

--SNIP-- “The evidence indicates that the derailment was caused the engineer operating the train far in excess of the speed limit,” the Philly DA’s office said in a statement announcing it had wrapped its investigation.

“However, we cannot conclude that the evidence rises to the high level necessary to charge the engineer or anyone else with a criminal offense.”

Prosecutors found no evidence that 34-year-old Brandon Bostian “acted with criminal ‘intent’ or criminal ‘knowledge’” when he accelerated Amtrak No. 188 to more than twice the speed limit on May 12, 2015, the office said.

That is the standard they use with Hillary, and they say they cannot prove it because she will deny everything. I think it’s the wrong legal standard. This engineer operated with reckless indifference to passenger safety, whether or not he intended to commit a crime.

It’s well known that the justice system in Philadelphia is controlled by the unions. In this case, his union decided to protect him.

If you did what he did with a bus full of people, you would go to prison, no questions asked.....why should a train be any different?...................

If a bus accident happened within the political limits of the city of Philadelphia and the driver were protected by a union, he wouldn’t be charged either.

“No criminal intent” is a truly absurd legal standard.
If the perp did harm or damage, his ‘intentions” are irrelevant.
