You are right, however, in non capitol offenses the 8th amendment states “no excessive bail”. Home invasion is not a capitol offense and it had been ten years since his previous arrest. There would be no room in jail if we held everyone before trial.
It’s constitutional to deny bail for someone who is a flight risk or a danger to the community as determined by a judge.
