Texas has put President Trump over a barrel with its threat to sue to stop the 2012 deportation amnesty for Dreamers, said legal analysts, calling the states case as close to a slam-dunk as possible.
Known in Washington as DACA, the amnesty was started by President Obama and was roundly criticized in last years campaign by Mr. Trump. Now in office, though, Mr. Trump has reversed himself and kept DACA intact, approving tens of thousands of new and renewal applications.
But the program has been on borrowed time for more than a year, ever since a series of court battles ended with the June 2016 Supreme Court ruling that invalidated Mr. Obamas second amnesty, the 2014 program known as DAPA.
Texas Attorney General Ken Paxton has now officially pressed the issue, saying in a letter last week that if DAPA is illegal, then so is DACA. He gave Mr. Trump until early September to phase out the program or else he will force the courts to rule.
This is a masterful stroke by Texas, said Josh Blackman, an associate professor at South Texas College of Law. He said Mr. Trump has been trying to have it both ways but will now have to choose.

Yes, it is. Let the states or some other party sue and let the Trump Admin pull an Obama and refuse to defend it.
Once a judge declares it illegal, a future Democrat administration will be unable to restore DACA via executive order, unlike if Trump rescinds Obama’s EO that created DACA.
Why wait until “early September”. Challenge its constitutionality NOW.
DACA is just as illegal and unconstitutional today as it was when candidate Trump called it that in August of 2016.
President Trump has decided to continue this program that has no basis in law.
It must be ended if we are to restore the rule of law.
They are still illegal aliens.

Trump is trying to let it slide past the 2018 elections to get the maximum senate gain.
Texas has it right, as well the people.
Being an issue that can be used to whip him in the media it’s a good thing to let Texas sue as then it won’t be Trump’s issue, but Texas, and or the people.
2018 is just around the corner, and the issue is a hot potato.
All the political calculations in this thread which excuse Trump for a giant flip-flop are kinda depressing.
There is no question that the right thing for Trump to do is keep his dang promise and kill it now.
If it comes back someday, the sames states could still sue.
Using the approach of not killing it now, but then not defending it against Tx and its righteous posse of states... is dishonest insider establishment swamp tactics. And, absolutely will NOT result in Trump NOT being blamed.
Using the Ryan/McConnell approach of waiting in fear always until after the next election is also not a valid strategy for anyone who believes in what they are doing. It is the tactic of perpetual fear-based fundraising and zero-accomplishment leadership.
For crying out loud, if we had really wanted a third stooge to accompany Ryan and McConnell in synchronized swamping, then we should have just elected Kasich.

Texas can get rid of a LOT of illegals if she actually takes action - remember when Perry boasted that Texas would protect her own borders - then caved and did nothing?
