NEWTON A former Burke County principal faces two assault charges after witnesses say he pepper sprayed Confederate re-enactors Thursday.
Former East Burke and W.A. Young principal Karl Philip Smith, 56, of Morganton, was charged by the Newton Police Department after witnesses say he used the pepper spray during a reunion parade, according to an NPD press release.
Smith, known by many as Phil, reportedly discharged the pepper spray when the re-enactors went to fire their weapons, the release said. He eventually was identified by witnesses, and officers took him into custody.
Cheryl Shuffler, the public information officer for the school system, said Smith is still a system employee, now working at the bus garage after retiring from his principal position June 30. He plans to officially retire from the school system Aug. 31.
This incident had nothing to do with the school system, Shuffler said.
Police found a small canister of pepper spray and a handgun on Smith during a search, the release said. Smith did have a concealed carry permit for the gun.
After charging Smith, officers released him on a written promise to appear in court.

Hopefully he’ll get an attitude adjustment either in jail or afterwards.
Long past time for these fly infested POSs to start fearing life after they do stupid things.
How is it they are allowed to throw urine at the cops, then.
He looks like a crazy basturd to me,check out those eyes.
To bad a re-enactor didn’t give him the cold steel in self defense...
And to quit wearing his mom's hats.
.
Do you really expect him to do jail time? I hope he does and given his crimes he deserves it, but don't you think the judge will take into consideration his background and high minded purpose? Better, I think, is for the person he attacked to sue his rear end for every dime he's got, plus attorney's fees.

Given his salary, he’s probably got a reasonably good car and a house, but not too much more, meaning a civil judgment would really hurt.
Something not right here.
Just the kind of person liberals put in charge of children.
“...Smith is still a system employee, now working at the bus garage after retiring from his principal position June 30. “
I’ll guarantee that every bus garage worker does more for a school than ANY principal. Principals are not required to be academics, for sure (education degree - duuuuuhhhh). They obviously can barely spell “leader” since a leaf in a stream has more direction control.
So what is that they do, besides take an obviously untalented teacher out of the pool?
He is not in jail. He was released on written promise to appear in court. If the charges are not dismissed he still will not go to jail after trial if found guilty. His reputation, political pull, standing in the Community will see that he never sees the inside of a jail cell. What he will do, in the near future, is murder one or more innocent bystanders because he is mentally unstable. The question that needs to be asked but won’t is why was he removed as Principal and transferred to the bus garage to finish his time before retirement. Failure to address that question will result in one or more innocents losing their lives at his hand later on down the road.
This incident had nothing to do with the school system, Shuffler said.”
I disagree, such ignorance, arrogance and disrespect for the rights of the individual, displayed by this creep are part and parcel of the leftist take over of the education system.
Well, this clown retires from his desk job on June 30th, so that should be the end of the story.
But something else is going on here.
By working a menial bus garage task he is on the payroll for two more months.
Why?
Maybe he gets credit for another full year for his pension. More bucks?
This is not a normal retirement path when the time in job is two months.
[Given his salary, hes probably got a reasonably good car and a house, but not too much more, meaning a civil judgment would really hurt.]
Sue him into bankruptcy.
Massive law suit from the victims should take care of the income and problem too.
One additional charge added: failure to notify officer that he was in possession of a concealed, permitted handgun.
