Since when are United States Marines denied 1st Amendment rights ? Especially when they are off duty, off base and in civilian clothing .

Getting arrested sealed his fate. FWIW, you can get kicked out of the military for a lot of things that are perfectly legal in the civilian world.

You are correct. The unwritten rule, I have heard, in the Marine Corps, is: Do not embarrass the Corps!
