Prosecutor: Fatal shooting of congressional baseball gunman justified

WASHINGTON — Alexandria’s top prosecutor says police were legally justified in using deadly force against the man who opened fire on a congressional baseball practice in June, injuring House Majority Whip Steve Scalise, of Louisiana, and four other people.

In a 41-page report released Friday, the commonwealth’s attorney for Alexandria, Bryan Porter, said police were justified in fatally shooting 66-year-old James T. Hogkinson who shot at Republican lawmakers practicing at a baseball field in the Del Ray neighborhood of Alexandria for an upcoming charity baseball game.

This is a developing story. Stay with WTOP.com for updates.

At first, I thought the headline meant they were stating the shooting of Steve Scalise was justified. Our corrupt legal system hasn’t quite sunk that far, I guess.

Was there ever any (serious) question about the justification of killing a criminal nutjob?

They had over 3 months, the cops only had a few seconds to make that decision.
I'm glad they agree.

What is nice to know is that the prosecutor got it right. I wasn’t even aware, though I should have been in today’s world, that anyone even questioned the action carried out by the police to use deadly force against the perp.

"This just in: After 3 months of careful analysis, lawyers have determined that it is not a crime for police to shoot down a gunman who is in the act of assassinating Republican Congressman."

"Should have been able to publish the justification in a 41 word memo!"

And within two days of the event. What waste of time and resources.

Apparently someone raised the question... don't know who.

How much time did Mr. top prosecutor spend in mulling over this question? If more than a minute, we are in deep trouble.

This thread perplexes me a bit.

This is a Leftist D. A. As such he makes a decision whether there are grounds to prosecute or not.

Sure, we agree with his conclusion, but we don’t want a one sentence declaration here. If he made one, there would certainly be a suit filed against the officers.

He not only came down on the right side in this ruling (something we should be thankful for), he went further and provided a lengthy legal basis for his decision. The longer that legal basis was, the better it was for the police officers.

This guy not only made the right decision, but he went the extra mile as well.

Honestly, we couldn’t have asked for more, even if it was an obvious decision. And it was.

This guy did right by the officers, in accordance with our views. Going overboard thanking him would be a good thing to do here, not dinging the guy as some have.

They would have been justified in pistol-whipping him first, then shooting him.
