Gov. Kasich Signs Law Banning Down Syndrome Abortions

Ohio Governor and former 2016 GOP presidential candidate John Kasich signed a pro-life bill on Friday December 22 that bans the abortion of babies diagnosed with Down Syndrome, reports Lifesite News..

The bill is officially known as the Down Syndrome Non-Discrimination Act. It passed the Ohio Senate by a vote of 20-12 and the Ohio House 63-30 in November. The bill bans abortions after prenatal tests show the baby is more likely than not to have Down Syndrome. Any individual who commits an abortion under these conditions would face a fourth-degree felony. Doctors could potentially lose their license.

A key distinction of this bill is that the mother would not be punished for her abortion.

Mike Gonidakis, president of Ohio Right to Life, issued the following statement:

“Now that the Down Syndrome Non-Discrimination Act is law, unborn babies prenatally diagnosed with Down syndrome are given a shot at life,” he said.

“Ohio is and will continue to be a state that sees the lives of people with Down syndrome as lives worth living, thanks to this legislation.”

State Rep. Sarah LaTourette introduced the bill and made similar comments.

"I believe that life begins at conception and that abortion should never be considered an option,” she said earlier this month, as CNN reported.

“However, regardless of if you agree with me or not, I hope that you can see that this is not an issue about abortion; it is an issue of discrimination -- discriminating against a person, not allowing them their God-given right to life, simply because they might have Down syndrome.”

As LifeSite News reports, 90 percent of of pre-born babies diagnosed with Down Syndrome are aborted.

I'm no fan of Kasich but I'll give credit where credit is due. He is bucking a worldwide trend to eliminate Downs Syndrome through selective abortion.

This is good, but how about a bill that bans abortions after prenatal tests show the baby is more likely than not to be a living human being?

But, isn’t it a shame that there are any abortions allowed at all, and paid for with taxpayer money?

How evil that “we the people” allow Just “Laws” to kill innocent human beings and also to promote something as vile, irrational and unconstitutional as homosexual “marriage” which negates Natural Law and God’s Laws (Our Constitution) just as killing babies do.

When are the politicians going to admit that evil “law” is no “law” at all, and “null and void” as Justice Marshall stated all unjust laws were?

We have to make them understand it is unconstitutional “laws” which are always unconstitutional.

It isn’t far off from the detestable practices of pagan religions that sacrificed babies to gods- sure- the women aren’t actively sacrificing their babies i n the name of gods these days- but they are sacrificing them in the name of their false gods pleasure and selfishness

I'm opposed to all abortion, but just in terms of logical consistency, I don't understand why it should be legal to abort children without Downs Syndrome while banning it for those children with the condition. Why not just ban all abortion?

This law will undoubtedly be challenged and will eventually end up before the Supreme Court - if the law survives it will do so because the judges are willing to undermine the Roe v. Wade ruling. Why not just make the stand now and ban all abortion in Ohio?

Agree. It makes absolutely no sense to ban abortion of a baby If prenatal testing indicates Down’s syndrome but to allow the abortion of the baby if the prenatal testing revealed the lack of Down’s syndrome. WTF?

Abortion is part of a “sliding towards Gomorrah” slippery slope.

Seems to me this bill is applying the brakes and gripping that slope, gaining just a little traction, to aim back up the slope. Its a start, and you gotta start somewhere.

Kasich gets one right. I pray God blesses him for this. He’s been on the wrong side of almost everything, but glad he got this one right. Oh, and all doctors who commit abortion, and all women who contract for the murder of their children, should be jailed or put to death.

Agreed. I think this is a self serving grandstanding act by Kaisch. You can’t protect one class of intrauterine people and not another. The Supreme court is not likely to let this law stand.

If a mother is allowed abortions until 16 weeks or until 12 weeks, or whatever the standard than Downs children are no exception. This law is so heavy handed that it is going to cause a revulsion in many people who would be happy to support restricting abortions to the first trimester. The States adjacent to Ohio will see an uptick in referrals.

Downs can be diagnosed at 10 weeks. Downs has many faces from mosaics who may have normal to above average intelligence to children with multiple physical & intellectual defects.

If the Supreme Court upholds this law, then we should follow it with one that states abortion is illegal is a child determined prenatally to be homosexual.

Let’s divide their side for once.

Ban aborting children with a gay gene (should one be discovered).

Bring the issue up and watch the Democrats oppose it, saying it is OK to abort gay babies.

Then, you pass another law that prevents the abortion of children based on gender.

Let’s destroy their coalitions.

Regarding the idea of a gay gene. I have heard that it is the hormones secreted by the mom while the fetus is in the womb that cause the baby to be born same sex. Also it is said that the foods and vitamins that the mother takes during pregnancy that contribute to the determination of gender. Supposedly, there are already books that tell women which vitamins to take to get a particular gender for the child. The slippery slope of motherhood may one day the include sexual orientation augmentation as well.

What happens here is that women who undergo prenatal testing are not the same group of women who use abortion for birth control. These women typically want to have a live baby. But they undergo the testing and either decide or are pressured to abort if the results show a non-normal baby. What Kasich has done is to say that, at !east in this case, a decision to abort a baby that was wanted cannot be made on the basis of the results of this test, if it shows Down syndrome.

I like Kasich’s move here, but I see potential for great difficulty here. Sometimes genetic testing reveal that a baby has a lethal disease, for example, Tay-Sachs. I think that almost all babies who are diagnosed prenatally with Tay-Sachs are aborted. Should we tell the mother of these babies that she has to go through with giving birth and caring for this child for the next four or five years until it dies miserably? Note: the abortion is incredible cruel and painful; there should be a requirement that it at least be conducted humanely, with anesthesia for the infant.

As with everything, there are nuances. In the case of abortion, about the only black-and-white issue is the subject of the use of abortion as routine birth-control, which is 90% or more of abortions. Clearly, that practice is inexcusable. But the subject of abortion of non-normal babies is not black-and-white at all.
