The California Attorney General’s office argues that his comments constituted “repeated contact by means of an electronic communication device” with “intent to annoy or harass,” a misdemeanor under California law...

Seriously?! As long as he put his name to it, openly stated his opinion, this seems clearly within the scope of the 1st Amendment. If he did it anonymously, I’d find that harder to defend. (Tired of people to hiding behind anonymity to spout things they don’t want to be associated with or held accountable for—if you wouldn’t say it with your name on it, probably shouldn’t say it.)

If someone doesn’t like what someone is saying to them on FB they can block them.

Take heart...there may be hope.A couple of years ago the Massachusetts Supreme Court upheld a law forbidding the possession of stun guns because given that they didn't exist at the time of the Bill Of Rights' adoption and because they're not suitable for use by the militia the right to possess them isn't covered by the 2nd Amendment.

The case went all the way up to SCOTUS,which ruled 9-0 that stun guns are covered by the 2nd Amendment.

At one point the SCOTUS ruling classified the Massachusetts court ruling as "frivolous".

A court that can issue such a ruling can also see through an equally frivolous attack on the 1st Amendment.

In case anyone's interested the case I referred to is "Caetano v Massachusetts"

You can’t tell Muslims their religion causes trouble? But you can despise and harass Christianity. Seems to me this case is an example of the trouble that comes with Islam. Probably be executed if you criticize the Iranian regime right now.

CA is not a free state.

Imagine a massive punitive homeowners association, where the board members are all vicious control freaks. That’s CA.

California government has offended and insulted me for as many years as I can remember. Every time I run into someone from California, I make a sincere effort to make them pay for it for voting for people like that. There will never be an apology for same no matter what the consequences up to and including my death.

Come get some.

Hey, FR is hosted in California, Jim is in California, maybe he could challenge the California AG to test this law on some idiot troller. Heck, with a broad definition "“repeated contact by means of an electronic communication device” with “intent to annoy or harass”, we are all guilty. Who hasn't annoyed someone at some point? For example, think of the Lyn' Ted fanatics still lurking here.

Poor use of California tax money, likely just headlines and name recognition for the attorney general to run for higher office.

And that’s just what the Muslims who run that Facebook page did. They blocked the guy. But that wasn’t good enough. The infidel must be punished.

They can’t do anything about telemarketers spoofing a number and calling you every f’n day from a different number, but this is an actual crime.

We need a purge.

Is California going to prosecute people that promote the Koran on line? It does call for the killing of us all.

Islamic Center of Southern California

.
,

This is a foundation that promotes itself on social media. He’s not harassing a person or making threats to a person is he? Did he threaten to blow up or attack the office of Islamic Center of Southern California???
If he just spouted off his social and political opinions then how can he be prosecuted?

“THE TERROR HIKE … SOUNDS LIKE FUN” (In reference to the Center’s advertised “Sunset Hike”)

“THE MORE MUSLIMS WE ALLOW INTO AMERICA THE MORE TERROR WE WILL SEE.”

“PRACTICING ISLAM CAN SLOW OR EVEN REVERSE THE PROCESS OF HUMAN EVOLUTION.”

“Islam is dangerous – fact: the more muslim savages we allow into america – the more terror we will see -this is a fact which is undeniable.”

“Filthy muslim shit has no place in western civilization.”

.

.
.

That is what he wrote. How is can you prosecute this man as a criminal for a POLITICAL POV??
I don’t see one threat.

Says a man posting under a handle.

Seriously, these days any conservative with a regular job is a fool to share his opinions on the Internet. There are lots of deranged leftists looking for people to pile on, to get them fired for any sort of non-politically-correct opinion. Mozilla CEO Brendan Eich got fired because a lynch mob sprang up over his having donated $1K in support of California's Proposition 8 (anti-gay-marriage).
