Seems to be 60 days Federal notice.
In NY state they say it is 90 days notice.
Didn’t say anything about pay that I saw offhand.

Well, now I know why and how they think they can get around the WARN act:

In light of sequestration set to take effect after January 2, 2013, the Obama Administration issued guidance saying “it is neither necessary nor appropriate for Federal contractors to provide WARN Act notice to employees 60 days in advance of the potential sequestration because of uncertainty about whether sequestration will occur.”

It does, however, say “in lieu of” so there are ways around it.

This was a piss poor way for employees and the public to find out, but Sam's is following the WARN act.

The stores are CLOSED TO THE PUBLIC effective today. Pharmacies will be open for two weeks to allow customers to transfer to another pharmacy.

Employees will be employed until March to assist in processing the store inventory. Management will be employed until mid-April to process all closure and separation paperwork.

SO - NOBODY WAS FIRED TODAY. ALL WILL HAVE JOBS FOR THE WARN PERIOD.

But in the hands of Trump, it is magnificent. Thanks, Obama and Clinton, for closing one gap in the separation of powers. Now, we have to stop the Judicial branch from thinking they are Congress.

It’s like Parliamentary government, where elections have MAJOR consequences. The prime minister always comes from the majority party, so things can turn on a dime. Sometimes that’s a good thing, sometimes not. LOL

We lived near a Ground Round at the end of the last century. Money was tight so we didn’t go out often but the Ground Round was relatively cheap for a chain sit-down. My favorite was the Fish & Chips with real non-farm-raised Cod. The best part of the experience was that we would get the same waitress every time and every time I would order the Fish & Chips, the waitress asked me if I would like fries with my dinner. It was so funny that every time we are out for a meal and I order fish and chips, my wife judges the place on whether the waitress asks if I want fries. It happened once at a Red Lobster a couple of years ago.

The WARN Act applies to private businesses with 50 or more full time workers in New York State. It covers:

Closings affecting 25 or more workers
Mass layoffs involving 25 or more full-time workers (if the 25 or more workers make up at least 33% of all the workers at the site)
Mass layoffs involving 250 or more full-time workers
Certain other relocations and covered reductions in work hours

Capitalism at its finest, which means you have to be fleet of foot if you want to run with the pack. It's hard nosed reality, survival of the fittest. Walmart has Amazon breathing down its neck with automated merchandising/marketing being the new wave. While it is tough on the workers, they can thank the President for creating an economy where hopefully replacement jobs can be had much easier today.

It’s called the WARN act. Employees have to be told 90 days out. Been through it. Don’t know how they are getting around it.

I thought the WARN act was for full-time employees only? Didn't Sams Club (like Costco) hire primarily part-time workers?

Or let employees in knowing the store is closing so they can take back out anything they like? I don’t understand your post.

Simply email/text/call them after the close the night before. That's all. Most closed locations were locked with signs out front. It's also bad P.R. for customers who have to view upset employees outside locked doors.
