Second U.S. judge blocks Trump administration from ending DACA program

A second U.S. judge on Tuesday blocked President Donald Trump’s decision to end a program that protects immigrants brought to the United States illegally as children from deportation.

U.S. District Judge Nicholas Garaufis in Brooklyn ruled that the Deferred Action for Childhood Arrivals program, or DACA, cannot end in March as planned, a victory for state attorneys general and immigrants who sued the Republican administration.

The plaintiffs had argued that the administration violated federal law by cutting off a program that hundreds of people relied on with little explanation.

In the ruling on Tuesday, Garaufis said the Trump administration could eventually rescind the DACA program. However, the reasons it gave last year for winding down the program were too arbitrary and could not stand, the judge said.

Garaufis ordered the government to process both initial requests for DACA status, as well as renewals, on the same terms as had been in place before the administration made its announcement last September.

means nothing, daca was an executive order I believe, not legal, court has no jurisdiction..

Let’s see if I have this correctly we now have two courts saying that a program that the courts have found to have been illegally implemented must not be stopped or that would be illegal?

I guess two wrongs do make a right. How sad for our Justice system.

The federal judge has no power. Trump is not cancelling the program, it dies on its own naturally unless Trump takes action to extend it.

Left out of the Reuters piece was this.

"The judge said the Trump administration can still rescind the program in the future if it does it the right way".

And he said the administration doesn’t have to approve any specific DACA applications. But it must begin to process applications again.

If Judges can act illegally...

Why should Trump be held to acting legally?

Further as you point out, what Trump is doing is not illegal. It is setting an illegality straight, ending it.

We don’t need a president, we have judges. Wasn’t DACA an EO from the Obozo? If that is correct, since when does a judge have authority to intervene and overrule a sitting president in the dissolving of an EO? More judicial abuse from a libturd Judge!

DACA isn’t a law to issue orders over? So exactly on what basis can a judge rule on? The judge has no standing. He might as well be ordering it to keep raining when the sun is out.
