Under 26 U.S. Code § 5845, "a rifle having a barrel or barrels of less than 16 inches in length" is an NFA device. Posession of an unregistered NFA device is a felony punishable by 10 years in prison and fines of as much as $10,000. Creating an SBR without paying the Class 3 Special Occupation Tax is a felony punishable by five years in prison and fines of as much as $100,000 (in some cases, $250,000).

Not that it matters but even with its gas tube cut, an AR15 is still a fully-functional, manually loading, repeating firearm because the shooter can continue to load it by cycling the charging handle between shots.

Ignorance of the law is no excuse.

No. If the reciever was not originally a pistol there is no way to reclassify it. Theoretically you could have two identical guns, one legal, one not.

What did she do about the gas system? The port that leads to the gas tube that transmits combustion gasses to the bolt is usually fairly close to the muzzle. If she cut the barrel too far back, she’d have had to rebuild the entire system.

After watching the video, it’s clear she ruined a perfectly good semi-auto rifle by cutting its gas tube. Not a very bright woman.

Well, since she finished dismantling the gun after she stopped her video, and turned the mess over to local police, she really isn’t in any trouble, just looks like an idiot.

Her big problem is believing that her destroying a gun that was in her possession somehow removes guns off the streets, or makes them less available — like she doesn’t understand the manufacturer can makes as many guns as people want.

The voter’s concern should be why she thinks she is so irresponsible that her AR-15 would have ended up in a mass shooting somewhere. if she can’t even trust herself to keep her own weapon locked up and out of the hands of criminals, why would anybody want her in a position of power?

It will still function like a bolt action, yank the charge handle per shot. The SBR rules apply to all rifles, not just semiauto.

IANAL but I think that if it was originally a rifle with legal length barrel and you cut the barrel to under 16, it’s an SBR even if the barrel is as short as a Chief Special snubby.

The BATFE guidelines on deactivating a firearm are pretty clear, and simply dismantling it DOES NOT COMPLY. Deactivation requires that it be modified in such a fashion that even a skilled machinist could not restore it to service. BATFE-compliant deactivation almost always involves a welder, a cutting torch or a hydraulic press/cutter.

The video is prima facie evidence of felony creation of an SBR without paying the Class 3 SOT, followed by felony possession of an unregistered NFA.

Saying she's not in trouble because she turned it in to police is like suggesting they won't charge you with murder provided you carry the dead body to the morgue when you're finished.

WRONG. Read 26 U.S. Code § 5845. 16" minimum barrel length is in a separate and independent clause from the one regulating barrel length AND overall length. That's why they call it a short-barreled rifle (SBR), not a short barreled AND STOCKED rifle (SBASR?).

That's why the Colt LE6920, which is the civilian-legal version of the military M-4 carbine, has a 16" bbl when the military carbine's is only 14.5".
