The farm worker would be, not Collins.

Collins filming the ICE agents or questioning their being on his property seems to be part of the issue here. I can see that agents should interact proactively with land owners and the accusation of a heavy handed approach is far too believable.

Still, I’m not gonna trust anyone to give the straight story in cases like this. Not the press and certainly not government officials on either side.

ICE responds to questions about Rome farm raid: Worker had a criminal conviction

Rome, N.Y. — The worker who was detained during a Rome farm raid Wednesday had a criminal conviction and had re-entered the country after being previously deported, said Adrian Smith, a spokesman for Immigration and Customs Enforcement.

But Smith did not answer the question of whether the officers who came onto farmer John Collins’ property, unannounced and without permission had any kind of a warrant.

In a statement, Smith said the worker, Marcial DeLeon Aguilar, who is from Guatemala, had been deported from the U.S. three times, most recently in January 2014. He said Smith has a criminal convictions for reckless aggravated assault and for illegally re-entering the country after being deported.

Smith did not provide information on when the assault occurred, or the circumstances. Smith also did not answer questions about whether the ICE officers had a warrant when they came onto Collins’ property or about whether the officers disputed Collins’ claims that they threw his phone and handcuffed him when he attempted to take video of what they were doing.
