An Executive Order that seeks to enforce the exact language of a federal statute cannot be challenged in federal court.
Only the federal statute itself can be challenged as unconstitutional. Since this statute is more than 50 years old, Trump can still enforce the law, exactly as written, until the Supreme Court declares it unconstitutional.
Bottom Line...
Trump can solve the DACA problem tomorrow, with no Amnesty - but only if he wants to.
Unfortunately, in my opinion, Trump has made it very clear that he is only going to deport criminal immigrants - and no one else.
Of course....
But he does want to end DACA .....however not until there’s a ‘solution’ to those here who have been here ‘along while’, without criminal charges, have work etc....he does not want to ‘just’ deport them. He’s made that clear.
He doesn’t even need an Executive Order. DACA was nothing more than a memo to DHS on enforcement/non enforcement.
Doesn’t Teump know how to write memos? This is Trump’s DACA. He wants it and wants them made legal. The cult followers are too blind to see it.
