The latest law which was slipped into the last budget allows for ‘diversion’ of anyone accused of a crime who can claim a mental health issue that is verified by a therapist. Got a DUI you’re dealing with? You drink because you were abused as a child by drunks - go to your county mental health program, and once completed, your crime is wiped away.

Killed someone? Must be because you’re having trouble coming to terms with your sexual identity. Complete the diversion program therapy and you’ve got a get out of jail card (and no conviction.)

I feel for every DA in California, and doubly so for every California county which will have to create zillions of diversion programs once the criminal defense attorneys start pushing their clients into these programs.

(There’s yet to be any court challenges to this law which I will expect especially when it goes up against things like ‘three strikes’ and other sentence enhancement laws. As written, it appears to compel the court to accept diversion if the mental illness is in the mental health manual prior to proceedings continuing - that may entirely preempt the three strikes enhancements as completion of the diversion negates the original arrest.)

California: A state that sanctions the murder of its citizens by foreign invaders. Actually New York is the same, New York city specifically. 3 weeks ago a gang made up of illegals - protected by the way by the sanctuary city policies of the Mayor - butchered a 15 year old to death. Rather than call the victims family to offer condolences, Mayor Bill DeBlasio called for ICE to be abolished. This is a Mayor openly and blatantly assisting foreign invaders kill US citizens and incredibly they reelected this asshole.

“The voters share the blame for the increase in out-of-control crime in the state. In 2014, voters passed Proposition 47, which was touted as a criminal justice reform measure. It cut penalties for certain “lower level” crimes. The East Bay Times called it a “leap of faith.” Yeah it was that all right, and the result has been a surge in car break-ins, shoplifting and other property crimes.

Every single law enforcement officer I’ve talked with says the same thing: There are more crimes and more people walking away from them.”

For me, the result of this Proposition is that we now have to have a number of security cameras that awaken us at home in the middle of night because we have one or more persons at our commercial office building “taking up residence” there to sleep, shoot up, take a $hit/pi$$ on the stairway, plug in their electric blanket, charge their personal electronic device, unscrew the light bulbs, etc. So we call the cops and thanks to this “new law,” they simply tell the people to leave. They tell us that a major portion of their calls for service involve the removal of ‘transients.”
In two years of video monitoring, we have only seen one arrest. The “transient” had an outstanding warrant.

A lot of us terrestrial AM radio listeners still miss you on the local dial. KSFO and KGO could certainly use you now, although Cumulus has too much pride to ever admit their mistake. You are one of the greats.
