Grassley suggests last-minute Kavanaugh hearing could be canceled if accuser doesn’t accept invite

Senate Judiciary Committee Chairman Chuck Grassley on Tuesday raised the possibility that next week’s high-stakes open hearing to examine the sexual assault allegation against Supreme Court nominee Brett Kavanaugh could be canceled if the accuser doesn’t accept the committee’s invitation.

Grassley, R-Iowa, scheduled a hearing for Monday for Kavanaugh and accuser Christine Blasey Ford to answer questions from senators about the allegation. But Grassley said during a Tuesday radio interview that his office has reached out several times to Ford and her attorneys to discuss her allegation, but has heard nothing back.

“Grassley should issue an ultimatum that if she does not accept by 10:00 a.m....”

Won’t happen. I’m no fan of Grassley but the problem here is that treasonous snake Flake. He would not go along or might even pull a McTraitor and switch his vote and kill the nomination.

Actually, the premise is false that if the allegations derail his SC nomination then he should be removed from the COA. That is because the standard for confirmation is the consent of the US Senate based upon the individual judgment and conscience of each Senator. The standard is a political choice. The standard for removal is at least clear and convincing evidence if not beyond a reasonable shadow of a doubt.

Now as the to liability of Dr. Ford, accusing someone of rape is per se slander and per se malice. She bears the burden to prove her claim with clear and convincing evidence. This is probably why she is ducking the opportunity to appear and testify under oath.

They’re up to something with this strategy...I just hope the Republicans are READY for it.

I caught a bit of Laura Ingraham’s show this morning. She said the GOP has assumed their normal fetal position on this issue. Dems all over media. GOP refusing to go on her show. How pathetic.

I’d just hold the vote and be done with it.

They can't. The female suburban Oprah Vote is apparently going wobbly.

Is she bipolar? Any link?

I suspect it’s all a question of what will push Collins, Murkowski, Flake and Corker one way or the other. I think all of them despise what is being done to Kavanaugh, but all of them are also heavily invested in their counter-party narrative. All of them understand the stakes. My guess is that they want to vote to confirm but don’t want to be perceived as doing so out of blind party loyalty or under leadership pressure.

Grassley should announce if by Wednesday the invitation to testify is not answered, the vote will be on Thursday.

Yep, that’s DEFINITELY the right move.

Kavanaugh is one of these establishment guys. Your logic makes little sense, McCain was giddy about Kavanaugh's nomination.

Is she doesn't show up, Flake's going to be like "oh well, we tried, time to vote."

Flake is bluffing. Kavanaugh is main line GOPe club and he won’t derail his nomination. If this was a MAGA outsider nominee then of course the GOPe would sink him.

They would certainly respond by saying he’s not fit for that court either. It costs them nothing to do so.

I agree 100%. If by Wednesday morning (Tomorrow), Ms. Ford or her attorney do not respond to the Judicial Committee invitation to testify in person in public and under sworn oath, Sen. Grassley should go forward with the Committee vote to move the nomination of Judge, Kavanaugh to the Senate floor for an up or down vote for confirmation.

Under the circumstances 48 hours is oodles of time to say I (Ms. Ford) will appear as invited or, I will not appear. Case closed!!!

It better not be a mere suggestion.

How about “Put up or shut up woman. You have two hours to declare your intentions.”

Exactly. The GOPe didn’t vote to repeal Obamacare because they love it. OTOH, Kavanaugh is their boy. He will be confirmed.

It’s clear, because of her hysterical personality, they never intended for her to be interviewed by the FBI nor appear as a witness in the hearing process.

This was a tar and smear campaign and the intended consequence was to flip this card over went all else failed.

They kept the star witness hidden for obvious reasons and now even Collins and the rest of the GOP smell the rat and know she’s a liberal activist.

She’ll never testify because she scrubbed all her social media sites....how in the world could she ever explain that before the committee and the American public.

Is Grassley even smart enough to know he was snookered from the start on this?

I bet the Dem strategy is that this poor metoo victim has already been victimized and is too traumatized to show and become a victim again, etc ad nauseum and that they want the FBI not Congress to investigate it even though the FBI has already declined to investigate this nonsense because they know a FBI investigation will take some time. Republicans need to cut this off and bring it to an immediate vote in the judiciary committee once she declines and full senate vote within a week and get it off the front page.

Grassley should not have said a word, then on Wednesday announce that the committee will vote the next day to forward Kavanaugh to the full Senate, since they have not heard from Ford.

The Dems will use her in the full Senate proceedings whether she appears before the committee or not, so push it forward now. Why give the Dems two chances to use Ford to disrupt Kavanaugh's appointment?

The standard is what they think the public will accept, whether it's approval or removal.

Al Franken was forced out over a grope of a sleeping woman. If he didn't voluntarily step down, he might have been expelled. Roy Moore would have been refused a seat for pursuing teenage girls. Bob Packwood, John Conyers, were forced out.

Sure, it's harder to oust a judge, but still comes down to what the politicians think the public will accept, regardless of what the standard of any actual procedural process has to be followed.

Rather than play process games, we should be playing to the court of public opinion, and force this question onto everyone who is waffling on confirming Brett Kavanaugh: is he a danger or is he not?
