Sen. Doug Jones (D-Ala.) said Tuesday that the Senate Judiciary Committee should subpoena a former classmate of Brett Kavanaugh as it examines sexual assault allegations against the Supreme Court nominee.
Jones weighed in shortly after the former classmate, Mark Judge, told committee leaders through his attorney that he won't testify and that he has no recollection about the alleged incident from the early 1980s.
"You can count on the fact that that letter, his response, is going to be entered into the record by someone, and that needs to be tested as well," Jones, who is not a member of the Judiciary panel, said on CNN.
"And I just think this committee if he doesnt want to do it and theyre gonna go forward with this hearing they need to subpoena him, let him say that and let some senators or someone cross examine him."
Under Judiciary Committee rules, a subpoena can be issued when there is an agreement to do so between Committee Chairman Chuck Grassley (R-Iowa) and the panel's ranking Democrat, Sen. Dianne Feinstein (Calif.), or when a majority of the committee votes to issue the subpoena.
Kavanaugh's nomination has faced new questions after The Washington Post on Sunday published allegations from Christine Blasey Ford, a California professor who alleges that Kavanaugh assaulted her during a high school party in the early 1980s.
Ford claims that Kavanaugh held her down and attempted to remove her clothes during the party, and then put his hand over her mouth when she tried to scream for help.
She told The Post that Judge was in the room at the time, and both he and Kavanaugh were intoxicated.
Ford said she was able to escape the situation when Judge jumped on top of her and Kavanaugh, sending all three tumbling.
Kavanaugh has denied the allegations and expressed a willingness to testify about them. Judge has also said he has no memory of the alleged incident.
The Judiciary Committee has scheduled a hearing for Monday to listen to Kavanaugh and Ford, though the latter has yet to confirm she will be in attendance.
Jones said he believes Republicans should have waited to schedule the hearing until after they spoke with Ford.
"This is a very brave person to come out in this kind of spotlight," he said. "And its not the kind of thing you just barrel forward without really talking to her and her counsel to see the best approach."
Jones was among the first Democrats who called for Kavanaugh's hearing to be delayed on Sunday after The Post published Ford's allegations.
The Alabama senator has not indicated which way he will vote on Kavanaugh's confirmation.
Whenever he's asked a question, Mr. Judge should respond, 'What party?' 'Can you tell me when this party happened?' 'I've been to many parties. Can you give me the date for this party?' 'Can you please be specific on the date, time, and place of this party in question?'

Has somebody testified regarding an allegation against Kavanaugh? I don’t recall anything. I do recall a member of the Judicial Subcommittee bloviating on about some letter she received, but I don’t remember hearing from the accuser.
I don’t see how they can force him to testify, as others have said he DOES NOT KNOW ABOUT EVER BEING AT ANY SUCH PARTY WITH KAVANAUGH EVER. Dems are clearly on a fishing assignment. Don’t take the bait.
How about digging into all these Senators and Congressmens lives going back to grade school and see what pops up?

If not for the duplicity of it all, this would seem to be a legitimate request. But now, even legitimacy itself is in question.
The only objective here for the Democrats is to delay, delay, delay. Not just until after the election, but until Trump can be driven from office.

Why should anyone amswer a subpoena? Eric Holder and Lois Lerner ignored subpoenas issued to them.

I agree 100%. Any eligible Alabamian who did not vote for Judge Moore is LIABLE if Kavanaugh is not confirmed. There is a direct chain of events from there to here.
