Analyzing H.R. 7059, the 'Build the Wall, Enforce the Law Act of 2018'

It took several days after House Majority Leader Kevin McCarthy (R-Calif.) publicly announced introduction of a new bill to fund the border barrier and implement important immigration measures before the text of the proposed legislation became available.

The bill McCarthy announced was the "Build the Wall, Enforce the Law Act of 2018", H.R. 7059,(1) which was described in the media as a "new get-tough immigration bill that would build the rest of President Trump's border wall, punish sanctuary cities and stiffen penalties on repeat illegal immigrants."(2)

The legislative language of the bill may not completely live up to its media depiction, but there are a number of extremely desirable law enforcement provisions crafted into the bill. Other features are desirable, but flawed as written and merit amendment to ensure that they have the effect intended. A few appear to be a step backward.

Following is a brief analysis.

The Center for Immigration Studies is Low-immigration, Pro-immigrant.

It is an independent, non-partisan, non-profit research organization founded in 1985. It is the nation's only think tank devoted exclusively to research and policy analysis of the economic, social, demographic, fiscal, and other impacts of immigration on the United States.

Kabuki theatre. GOPe does not want this to pass while they still have a majority and only are running this to be able to point to it and say, “See, we tried!”

This should have been run two years ago.

The bill also amends INA Section 236, relating to apprehension and detention, by adding a provision requiring mandatory detention of alien criminal gang members and associates. It further precludes such individuals from accruing various benefits under the INA, including asylum, temporary protected status, special immigrant juvenile status, or parole except when the individual is to be paroled to “assist” the U.S. government in a law enforcement matter.

Note that the bill does not preclude criminal gang members who are resident aliens and later charged with deportability for their membership from the benefit of cancellation of removal. This appears to be an oversight that should be rectified.(18)

DC is full of “conservative” politicians who are all in favour of things as long as they will never pass and become law.

A lot of people south of the border and in Washington make money off the Narco & Human traffickers. Billions spread around. They don’t want a wall or anything close to it. Trump has been pushing against very powerful forces. May God protect him.

I wonder how serious McCarthy is about this bill. Many ads were running for it several days before the election. And why wait until the last weeks of this Congress to start promoting it?

The Republicans FAILED their constituents miserably and are without excuse. They must be made to pay for their treasonous behavior. How to do it without taking Trump out with them?

I just called my Senator's office and my congressman's office...don't let this die " "Build the Wall, Enforce the Law Act of 2018", H.R. 7059,(1) get with President Trump and demand this be passed NOW. We have to fight the GOPe as never before.

This bill was an election year stunt by Kevin McCarthy to look tough so he’d get grass root support for his run as GOP leader in the house. Evidence: He had his PAC run commercials on radio nationwide taking about how “Congressman Kevin McCarthy and President Trump” are tough on border security. This bill existed so he could run those commercials.

I guess the first line of the 4,000 word essay indicates this author suspects the CA Congressman’s true intentions:

It took several days after House Majority Leader Kevin McCarthy....

publicly announced introduction of a new bill......

before the text of the proposed legislation became available.

McCarthy waited to the nth hour. Now it is very late to amend the bill and present it to the Senate.

Any alien who reenters after having been removed three or more times is subject under the bill to a sentence of 10 years imprisonment.

Just finished watching “Narcos” series on Netflex. Get a chance to watch it. History of the big drug lords, cartels, true story of several DEA agents who tried to do right thing but governments including ours, made it difficult.

While those DEA agents were putting it on the line to stop the cartels, the CIA was working with the cartels to import drugs for their off the books operating dollars.

Our fedzilla government was, essentially, at war with itself.
