Unfortunately, yes. Ever since Jefferson affirmed the power of the Federal courts over the executive branch out of sheer expedience in Marbury vs Madison, we’ve been subjected to a two century period of rolling constitutional conventions conducted by Federal judges. Unfortunately for us, the constitution is whatever Federal judges say it is. We should limit the Federal judiciary’s power by limiting its tenure to perhaps 10-year fixed terms, subject to renomination on a staggered schedule, much like the members of the Board of Governors of the Federal Reserve System.
All I said was that your interpretation is not shared by the courts thus far. And, for all we know, one of these Russians may make a fine President.
