A Ninth District judge indicated disappointment that a Rifle woman accused of yelling at two Spanish-speaking women in a racially charged rant at a Rifle grocery story will not have to enter a plea.
Garfield County Judge Jonathan Potosky said at a hearing in the case Wednesday he would have liked to see Linda Dwire, who was charged with misdemeanor racial-motivated harassment enter a guilty plea of some kind of condition of having her case diverted.
The charge results from an incident at the Rifle City Market in October — part of which was caught on video by a bystander and went viral on the internet — where Dwire allegedly was yelling at two women for speaking in Spanish.
The diversion program was at the discretion of prosecutors, and it was not in his power to compel a plea, Pototsky said.
The point of the diversion program is to divert the case away from the court, and the court has no way to stop it.

I imagine this would be a basis for a change of judge motion on the basis of bias for anyone charged with the same crime in this court in the future.
Maybe she’s not the most polite person in the world, but it is a crime now to say something to somebody that they don’t like? She didn’t threaten them, she said this is America speak English. I would’ve voted not guilty.

First amendment earns her a third vote. If her comments are a crime, we are all likely criminals. I know I have made comments in public that some snowflakes might object to that were not PC.
What if she had yelled at them in Serbo-Croatian? Just wondering.

Not long ago two women in a laundrymat were harassing my wife in Spanish. On and on they went.
What they didn’t know is my wife is fluent in Spanish.
Wonder what racist judge would take on her case?

On a previous thread, it was mentioned that Jimmy Kimmel mocked Melania Trump for having a foreign accent. Couldn’t this be construed as: “misdemeanor racial-motivated harassment”.

Facing criminal charges to telling these people they should be speaking English? How stupid are these people in Rifle?
This never ending conga-line of non-English speaking foreign nationals/illegals the government has forced upon our country are costing tax payers 10 of millions, simply due to the fact these people do not speak or even bother to learn English.
They apparently don’t teach constitutional law at Western Michigan University’s Cooley law school.

I'm gonna guess ole Judge Pototsky is just disappointed that the citizens of SOLID RED Garfield County, CO are going to have a chance to find the accused NOT GUILTY. Who the hell is this woman to demand her right to a fair trail by a jury of her peers? Admit your crime and accept your punishment, err "diversion"!
Maybe they should confiscate the Rifle.....

Are there really people out there who are that easily triggered? There are guest ranches out here where Mexican tourists stay and spend money in our businesses while they are here-so many of us speak Spanish as a 2nd language, no matter what our ethnicity. We would just have ignored the ranting woman and gone on about our bisiness- people have the right to be rude if they choose...
