We were never intended to be a government by judicial fiat, but the threat has always existed....However its no accident that the Constitution grants Congress the right to make the Supreme Court as large or small as it likes.

While only the Senate votes to confirm SCOTUS appointments, it would take majorities in both houses to change the law. Of course, the House would never approve, nor the Senate likely. Now if the Dems get the Presidency and both houses of Congress, they’d do it in a heartbeat. Why? Because their thoughts and policies and ideas are right and we are despicable pond scumin their minds.
If a communist wins in 2020, they are going to do it. If Trump were to goad them all into voting against doing that now, then they wouldn’t be able to justify it later.
The Demorats are viewing that the Supreme’s conservatives stand in the way of their agenda. ..so enlarging the court is their way of balancing what they see as stagnating anything they want to do.
