Roger Stone explains why he’ll be pleading the Fifth before Congress

Stone discussed his decision to invoke the Fifth Amendment and refusal to submit documents requested by House Judiciary Committee Chairman Jerry Nadler.

“Trump is guilty, he says, and now we just need to find the evidence. I call this a fishing expedition,” he said. “I don’t think Nadler has any evidence of Russian collusion or conspiracy or treason.”

He said he believes Nadler is trying to lay the groundwork for introducing articles of impeachment against Trump “in a rapidly left-wing Democratic House.”

“I have elected not to participate. I’m executing my Fifth Amendment right given the fact that I’m facing this legal proceeding in Washington,” he said. “I have no intention of going before this committee or supplying any documents whatsoever.”

Stone delivered his response to Nadler this week...

“Mr. Stone respectfully declines to produce any documents, and declines any potential invitation for an interview which may follow,” Stone attorney Grant Smith wrote in a letter to Nadler, obtained by Fox News. “The production of documents that may be responsive to this fishing expedition request would unquestionably be a testimonial act protected by the US Constitution.”

I don’t think he can invoke the 5th amendment.

But he can simply refuse to answer any questions.

I may receive a subpoena to appear...there is no compulsion that I answer any question posed.

Nadler: Did Mr. Trump .....

Me: Go “F” yourself.

Why dont you think so? One doesn’t need to be under an active criminal prosecution, but the fact that he is pretty plainly demonstrates the propriety of invoking the 5th

I'm not a fan of the phrase "plead the Fifth," since nobody has to argue for permission to do it.

The proper usage is to assert his fifth amendment protections.

I respect law enforcement. But if I learned anything from the Trayvon Martin episode, NEVER speak to the police without a lawyer. They are NEVER on your side, and are always trying to find “evidence” to convict you... no matter how nice they appear.

He sure as hell can. They can only compel testimony IF they grant him immunity. And he is already in the middle of a criminal case so every word in his testimony would be available to prosecutors. And Stone alone gets to decide if discussing something could potentially expose him to prosecution.

He must appear, but then he can indeed invoke his 5th amendments rights.

He should have invoked the 5th from day one.

The only way you talk is if granted immunity. If not, say nothing. Do not answer any questions.
