Trump, GOP states ask appeals court to kill Obamacare

Taking a harder line on health care, the Trump administration joined a coalition of Republican-led states Wednesday in asking a federal appeals court to entirely overturn former President Barack Obama's signature health care law — a decision that could leave millions uninsured.

Congress rendered the Affordable Care Act completely unconstitutional in 2017 by eliminating an unpopular tax penalty for not having insurance, the administration and GOP states told the court.

The "Obamacare" opponents hope to persuade the 5th U.S. Circuit Court of Appeals in New Orleans to uphold U.S. District Court Judge Reed O'Connor's ruling late last year striking down the law.

If the ruling is allowed to stand, more than 20 million Americans would be at risk of losing their health insurance, re-igniting a winning political issue for Democrats heading into the 2020 elections. President Donald Trump, who never produced a health insurance plan to replace "Obamacare," is now promising one after the elections.

Legal battles aside, the Obama health law has remained remarkably stable. Even with the repeal of the law's tax penalty, 11.4 million people signed up for coverage this year, just a slight dip from 2018. The law's Medicaid expansion continues to insure about 12 million low-income people. And several million young adults are on their parents' health insurance as a result of the ACA.

No individual mandate - it’s dead, Jim.

I mentioned last year that this is the first year that there is no mandate and will mark the end of Obamacare for all intents and purposes - and that it would, by the end of the year, be one of the major stories of the year.

It is being overshadowed right now by the Mueller stuff, but give it time.

Shame the Republican Congress didn’t have the guts to fulfill their promise for a clean repeal of the ACA, but see if this works.

Equally shameful was the Republican electorate unwilling to hold them to it. All too willing to accept the excuses and to ‘move on’.

Hopefully this will go our way and stand up to the liberal whinning.

Please explain, Mr. AP, why those 20 million people won't just purchase insurance on the open market? If they want to be irresponsible and not be uninsured, isn't that their choice in a free country? If we get the government (somewhat) removed from meddling in the insurance market, rates will go down and affordability will improve. Remember all the absolutely horrendous multiple insurance rate hikes that happened after Obama made healthcare "affordable"? Those will go away with far less regulation.

And unicorns poop out Skittles! How many young people have dropped coverage altogether because it is too expensive? All the more incentive to do so now that there is no longer a penalty for doing so.

NBC follows ObaMao Era thinking, IOW, the food stamp program was highly successful because so many people lost jobs (or hours) and signed up.

Subsidize anything and you will get MILLIONS signing up.

John Roberts, a new POTUS and some red states go back to the Fed courts asking them once again to overturn the clearly unconstitutional Affordable Care Act.

Eventually it ends up at SCOTUS, where your colleagues split 4-4.

What do you do? WHAT DO YOU DO???

One of the few groups who have NEVER been subject to Obamacare are Congress and their staff.

I know a double handful who had insurance they could barely afford who now have insurance they just plain can’t afford to use.

Still need to repeal it. Setting the penalty to 0 means it can be set back up by someone else just as easy. RINOs blew it just like with the wall.
