It is not settled law that non-citizens can’t be included in congressional apportionment. I think Barr mentioned in his comments today that issue is currently in the system....somewhere.

Citizenship has been ascertained in various forms for mo0st of the 220 years the census has been performed.
SCOTUS concurred that Commerce has the power to ask the citizenship question. There is no question.
But Roberts is an ass. He sent the case back to the lower courts because Ross wasn’t ‘clear enough’.
POTUS will continue to fight in the lower courts and then come back and win in SCOTUS.
But in the meantime, he’s ordered Commerce to go full steam with statistical inference to get the portions accurately estimated.
Donald Trump likely called in his top directors at Commerce and poured over the alternatives. The Census is one of the premier breeding grounds of accurate efficient estimation algorithms. Look up W. Edwards Deming to understand. We can be assured those Census Directors briefed POTUS thoroughly what the alternatives were, what works, what can be defended.
I said I heard it yesterday too but nobody was listening. He said it would be a big fight with Dems but it’s doable.
One thing I see is in the total number of eligible voters. Surely this information will show how many illegals are in each state. If a state has more voting than registered voters, or a higher percentage than normal voting by citizens, that should raise a red flag for voter fraud, especially in blue states without voter ID.
