Why should they? Do Kagan and Sotomayor recuse themselves from such cases? Heck, Kagan didn’t even recuse herself from the Obamacare case, on which she had worked as an advocate while serving in the obozo administration.
In stark contrast to the rights that the Founding States expressly protected in the Bill of Rights, especially 1st Amendment-protected freedoms of religious expression and speech, the later ratified 19th Amendment expressly protecting on the basis of sex only in the context of voting rights issues, the states have never amended the Constitution to expressly protect so-called, politically correct LGBT “rights.”
So when outcome-driven activist justices take on LGBT cases, it gives them an opportunity to legislate politically correct rights from the bench, so-called LGBT “rights” in this example, just like pro-murder of unborn children activist justices did when they legislated from the bench the phony constitutional right to have an abortion imo.
