Supreme Court appears inclined to let Trump end DACA Program

WASHINGTON — A bare majority of the U.S. Supreme Court appeared likely Tuesday to let the Trump administration follow through on its plan to shut down DACA, the federal program that has allowed nearly 800,000 young people, known as dreamers, to avoid deportation and remain in the U.S.

With hundreds of DACA supporters rallying outside — so many that police shut down the street in front of the Supreme Court — the justices heard nearly an hour and a half of oral arguments. Based on their questions, it appeared that the court's five conservatives were inclined to rule that the Department of Homeland Security acted properly when it ordered the program ended in 2017 and that the federal courts cannot second-guess that decision.

While Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, and Brett Kavanaugh appeared likely to say DACA was properly shut down, Chief Justice John Roberts did not seem to be as strongly convinced. Roberts may be the deciding vote, just as it was last term when the court blocked the Trump administration from adding a citizenship question to the 2020 census form. He concluded in that case that the government did not give an adequate explanation for its proposed action.

Illegals come here pregnant in order to have their kids on American soil so they can get citizenship its that simple. They use their kids as pawns for freebies it should END

Very poorly written article. Also, questions asked is no indication on how they will rule. Roberts is likely to side with the Libs on this and he will find a way to say he has the right to do it but not in this way. The when Trump does it in the way outlined the lower courts will still rule against him and this will go back to the Supreme Court. The “justice” system is a complete joke. Why should it take them until June of 2020 to rule on this? I’d the system was working there would be a judgement inside of a month and they wouldn’t turn this into a campaign issue. The court should be moved out of DC into a rule area and the justices should have a best before date.

This sentence does not seems to fit the tone of the title of this article.

Roberts must have been compromised.

It’s the only thing that can explain his absurd Obamacare decision.

But that doesn’t mean those who own him call in their chits all the time.

They probably save it for a just a small number of matters.

Guess we’ll see if DACA is on that list.

Good to know about EO’s. I have mixed emotions on this issue.The DACA made no decisions on their own. Once here, they got right into the American Way. They sought education and advancement, along with the big taxpaying that goes with the lifestyle.

I say amnesty for all DACAs here, but maybe change the law for the future.

Agree. No way SCOTUS is going to prevent a President from rescinding an EO.

If they rule that President “We Like” can implement de facto legislation by fiat but prevent President “We Don’t Like” from doing the same (rescinding an EO is basically the same as implementing the opposite), they’ve pretty much put themselves out of business.

If DACA can’t be turned off, what legal difference is there from President “We Like” implementing an EO stating that any judicial ruling he doesn’t agree with is null and void?
