A federal appeals court says Mississippi's ban on abortion at 15 weeks is unconstitutional.
The 5th U.S. Circuit Court of Appeals issued the ruling Friday.
It says a lower court judge ruled correctly when he blocked the state law from taking effect in 2018.
The only abortion clinic in Mississippi sued the state after Republican Gov. Phil Bryant signed the law.
Mississippi legislators came back in 2019 and passed a more restrictive law to ban most abortions at about six weeks. The same federal district judge blocked that law too.
A legal fight over it continues.

So heres the ironic part - think these courts would studiously defend the rights of gun ownership like these pro-killers do for a right not even enumerated in the constitution?
Wouldnt it be great if courts defended the Second Amendment, as well as they defend the, um, whatever amendment abortion is mentioned.
“unconstitutional” means whatever they don’t like. Wouldn’t it be great if they had to actually refer to what part of the constitution they’re talking about?
They usually refer to equal protection.
But you are essentially correct. Unconstitutional means anything they find personally undesirable.
If Miss. had the guts and was willing to do without the co-dependent federal funding, they should IGNORE THIS PATENTLY UNCONSTITUTIONAL RULING and mover forward with banning abortions. So should the rest of the state.
I hope that Trump judge James Ho hasn't "grown in office"...
James Ho is a Federalist Society member. I saw that he wrote a concurring opinion, but I didn't have time to examine it.
I'll try to post my opinion of it later.
