The U.S. Supreme Court ruled Tuesday that the parents of a 15-year-old boy cannot sue the federal agent who shot him by firing across the border separating the United States and Mexico a case that inflamed tensions over border security.
The ruling was a defeat for the parents of Sergio Hernandez Guereca, who was on the Mexico side when he was killed in 2010 by a Border Patrol agent who fired from the U.S. side of the boundary separating El Paso, Texas, from Juarez, Mexico.
The teen, a Mexican national, was playing with three friends in the cement culvert that separates the two cities. They dared each other to cross the unmarked border, run up and touch the fence on the U.S. side, then run back to the Mexican side.

Yup. I dont feel anything at all for the kid. I must be a heartless American.
It’s a tragic case. There was no evidence the kid posed any threat to the agent although others present apparently did. It’s an example of the adage hard cases make bad law. In this case, the four liberals would have made bad law, extending a Constitutional tort to actions occurring in foreign countries.

The teens were daring each other to run up to and touch the border fence then run back. The Border patrol caught the kid. His friends started throwing rocks at the agent. The agent shot at the kid he had caught and hit him in the head as he was running away (he had not thrown any rocks). Doesn’t sound justified to me.

Hopefully our justice system will determine if the shooting was justified and will respond accordingly.
