Can Trump just let them expire? I think there is no reforming them.
You can’t ensure that the FISA system will never be used against a US citizen in the US. You just can’t. Better to kill it completely.
It could be codified into law, such that:
NO EVIDENCE THAT IS OBTAINED FROM A “FISA” WARRANT CAN EVER BE USED IN A COURT OF LAW AGAINST AN AMERICAN CITIZEN.
Remember, the “F” in “FISA” means “FOREIGN”....................
That is supposed to already be enshrined in law in several places, starting with the 60s block on the CIA operating domestically and CIA surveillance being barred from use in court. It didn’t stop the RUSSIA RUSSIA RUSSIA usage, did it?
Make ‘Leap Frogging” illegal.......................
It’s already supposed to be. “Fruit of the poisonous tree” and all that.
Sure didn’t matter to the FISA court, now did it?
Supposedly the court did not know the fruit was poisonous at the time...............supposedly..........
And they’ll claim the same thing about other Leap Frogged material going forward.
No secret courts, no star chambers, nothing. We cannot trust them, so we must abolish them. They cannot be used safely.
But wait a minute! All they need do is to target a foreigner “seemingly close” to an American as a segue into the same old abuses to then ago after the American and anyone associated. There needs to be some serious oversight on the basis for the dweeb justice signing off on these things. Perhaps needs to be signed off by 3 or more justices, with serious consequences if not supported by factual data, whatever, and then hang ‘em all if flagrant, political, illegal, lacks the stated basis, etc.
