116th CONGRESS 2d Session S. RES. 532
IN THE SENATE OF THE UNITED STATES March 5, 2020 Mr. Hawley (for himself, Mr. Daines, Mr. Braun, Mr. Scott of Florida, Mr. Tillis, Mrs. Loeffler, Mr. Cramer, Mr. Sasse, Ms. Ernst, Mr. Lee, Mr. Cruz, Mr. Perdue, Mr. Scott of South Carolina, Mr. Inhofe, and Ms. McSally) submitted the following resolution; which was referred to the Select Committee on Ethics
RESOLUTION Condemning and censuring the Senator from New York, Mr. Schumer.
Whereas the Senator from New York, Mr. Schumer, is the Leader of the Democratic Caucus and a former member of the Committee on the Judiciary of the Senate;
Whereas, at a protest at the Supreme Court of the United States on March 4, 2020, Senator Schumer inveighed against 2 Associate Justices of the Supreme Court of the United States by saying, I want to tell you, Gorsuch, I want to tell you, Kavanaugh, you have release the whirlwind, and you will pay the price.;
Whereas Senator Schumer went on to warn Justice Gorsuch and Justice Kavanaugh, You wont know what hit you if you go forward with these awful decisions.;
Whereas the statements of Senator Schumer are an attempt to unduly influence the judicial decisions of the Supreme Court of the United States and to undermine the vision of the founders of the United States of the complete independence of the courts of justice, as Alexander Hamilton wrote in Federalist No. 78;
Whereas the statements of Senator Schumer could be read to suggest a threat or call for physical violence against 2 Associate Justices of the Supreme Court of the United States;
Whereas the Chief Justice of the United States immediately rebuked Senator Schumer, stating that threatening statements of this sort from the highest levels of government are not only inappropriate, they are dangerous;
Whereas, according to the Institute for Economics and Peace, political violence in the United States has increased over the last decade;
Whereas, in 2018, the United States Marshals Service investigated 4,542 threats and inappropriate communications against the judiciary;
Whereas 4 Federal judges have been targeted and murdered since 1979 and 2 family members of another Federal judge have been murdered; and
Whereas Senator Schumer has acknowledged that threatening statements can increase the dangers of violence against government officials when he stated on June 15, 2017, following the attempted murder of several elected Members of Congress, We would all be wise to reflect on the importance of civility in our [N]ations politics and that the level of nastiness, vitriol, and hate that has seeped into our politics must be excised: Now, therefore, be it
Resolved, That the Senate
(1) censures and condemns in the strongest possible terms the Senator from New York, Mr. Schumer, for his threatening statements against Associate Justice Neil M. Gorsuch and Associate Justice Brett M. Kavanaugh; and
(2) calls on all members of the Senate to respect the independence of the Federal judiciary.
Censure is appropriate. Show some shame from a party that has none.
Isn’t Schumer guilty of obstruction of justice?
Threatening the life and safety of 2 Supreme Court justices on national media is a little bigger problem than a telephone conversation with the head of a sovereign state where the transcript shows nothing wrong happened.
But since the party of hate, violenc, evil, and death has no shame, what good will censure do?
You are absolutely right but I doubt he will be censured let alone what he actually deserves.
Schumer thinks he is above the Law. He is obstructing justice, and is NOT above the Law.
Bee-Eff-Dee ... he is a politician and a democrat, does anyone thing he gives a ratzazz about a strongly worded censure? If you do, get off the internet and go back to playing in your sandbox.
UpChuck threatened a high-ranking Federal government person out in the open where he was not protected by some ancient and arcane law that allows politicians inside the Senate building or inside Congress to lie and slander other folks. Therefore what he said is against the law. One could actually consider his words to be a call to arms for some leftist fanatics to carry out violence.
A censure carries no penalty for the act referenced. UpChuck will not lose his pension. He will not do jail time. He will not have to pay a fine. Absent any punishment that actually impacts his life, does anyone expect this behavior to change?
Agree. I called both Senators to support this action.
He doesn’t know what’s going to hit him!!
We should apply some arab justice to Schumer. The Supreme Court members should flog Schumer's face with their shoes - repeatedly, live on TV. That would be appropriate.
Lets us make them all a minority! TAKE BACK THE HOUSE!
Screw it! I’m tired of waiting for pussies to do a man’s job! I’m going to speak sternly to Mr Schumer possibly even HARSHLY!
Chuck Schumer is an insurrectionist and a Democrat.
Oh, sorry. Redundant.
It’ll be lucky if it gets 40 votes
It’ll go nowhere...
Why aren’t there 53 co-sponsors on this?
Where is #3...Send his sorry butt packing or arrest?
I called Sen. Tillis’ office (NC) and the person I spoke with said Sen. Tillis (who is up for re-election) WOULD BE voting for the Censure of Schumer if/when it comes up for a vote.
I also called Sen. Richard Burr (NC - not up for election) and Sen. Graham - got answer machines both places and left messages.
Great.
