Every email is recorded and stored on NSA servers.
The 4th Amendment prevents NSA from using emails of Americans in a case against them unless An American in question is linked to a foreign source who is under investigation.
Hillary Clinton had many dealings with foreigners. If any of her foreign contacts are under investigation, NSA should be able to allow her emails to be used in a court of law. But I suspect they hold such records back as that would tip others off as to methods and sources.
But intel agents with FISA authority will be able to know the answers of what was in the deleted emails. But any evidence uncovered may not be admissible.
