Shirkey’s language is not very clear. It seems to leave things open to subjective interpretation by saying “in such a way as to intimidate”, stepping outside what the legal meaning would stipulate for the word “brandish”.

anyone can claim intimidation just seeing something even though its legal to display or be seen with said something
