I am mystified as to why the Justice Dept. and Flynn’s Defense Counsel haven’t yet petitioned the DC Circuit to remove Judge Sullivan. I have heard a lot of talk about that being a natural course of action, but nothing has happened yet. Why not?
The immediate thing to do would be appeal the request for amicus briefs. I don’t know if they need Sullivan to do something to finalize the order before they can do that.
I think the DOJ and Flynn are waiting for
to keep digging a deeper hole.
