So, let me get this straight- the president keeps retweeting a Michael Moore original conspiracy, the family of the alleged victim call him out and allege emotional distress so Twitter will put some type of “disclaimer” on tweets where the president is accusing random people of murder. The president freaks out, claims he was “censored” (nobody uses that term correctly) and tweets that he is going to do something, so his aides run around and come up with cut-and-paste nonsense to make the story go away.

Prediction: Facebook, twitter, et al. go forward unchanged.

Many saying that this is just going to launch a “study” into censorship on these platforms. I seriously hope this has more teeth than that.

Government is outsourcing totalitarianism. Government has no need to censor you speech if a private company does it for them.

You should see this commentary from John S Mosby.

Will that include a boycott by the Executive Branch as well?

Where in the Constitution, the ONLY source of legitimate power of the feds, is this power specifically enumerated?

I'd be happy to answer your question the moment you show me where Whitmer, Murphy, Wolf, Cuomo, Garcetti, de Blasio get their power to [...] Show me which part of the constitution says they can become tin pot dictators.

The Constitution limits the states, if at all, only through the Supreme Court's "incorporation" interpretation of the 14th Amendment - but that same Court has never ruled that the Bill of Rights limits state authority to declare a quarantine for public health.

This provision does not allow platforms to remove whatever they wish, however. Courts have held that “otherwise objectionable” does not mean whatever a social media company objects to, but “must, at a minimum, involve or be similar” to obscenity, violence, or harassment. Political viewpoints, no matter how extreme or unpopular, do not fall under this category.

Well, I don't think that's been established in court, but it's probably not even important in the case of FB, Twitter and YouTube because every user agrees to the TOS as a condition of using the service.

Section 230 or not someone suing would have to show the company breached their own terms of service. I'm not up on any of the TOS agreements but I'd wager the techs' have protected themselves pretty well.

You quarantine the sick and the infected. You don’t quarantine everybody in entire states, with most of them strong and perfectly healthy, and strip everybody of their inalienable God given rights to live as normal human beings, and put a dictator’s boot on their jugular veins.

Except this had anything to do with a Michael Moore conspiracy theory. It wasn’t even a retweet.
Wanna try again?

It has.

TOS has nothing to do with it. If they lose their 230 no TOS is going to protect them.

It has.

Cite?

If they lose their 230 no TOS is going to protect them.

So in addition to stripping their property rights we're eliminating their ability to make a contract?

1. While the First Amendment generally does not apply to private companies, the Supreme Court has held it “does not disable the government from taking steps to ensure that private interests not restrict . . . the free flow of information and ideas.”
