Nor, under the circumstances of this case, may the district court assume the role of prosecutor and initiate criminal charges of its own. Instead of inviting further proceedings, the court should have granted the government’s motion to dismiss.

Sydney has 7 days to file a reply brief on Sullivan’s brief. Given the Solicitor general’s response I would suggest she file a very short reply to Sullivan saying that Sullivan ducked the issue, there are only two sides in this case and both have agreed to file. There is no third party and he doesn’t represent them.

There is no case currently in existence to prosecute since both sides agreed to dismiss. The judge no longer has a case to adjudicate.
