A federal court has no jurisdiction. Trump declared an emergency, and that allows him to operate outside the codified law to deal with the emergency. It is not subject to judicial review. The declaration of emergency is literally him declaring he will be operating outside of legal structure as commander in chief.

If he oversteps in exercising his presidential power to deal with the emergency, the Constitutional remedy is that Congress can convene, pass legislation overturning his Emergency. If they do it with 2/3s, they check his move. If he still refuses, they can impeach and remove him.

Judges have no role.

The 9th circuit in fact is breaking the law. I wish I could remember where to find the law passed by congress that allowed Trump to do this after making and emergency declaration. According the law Congress can try to override him by super majority vote. Which they tried to do and failed.

What we need in this country is a constitutional amendment which impeaches judges who clearly violate the law in their ruling.

Finally someone who knows what they are talking about. Don’t forget that congress did try that. And they failed. That means that Trump totally has the green light to do what he is doing.

“I think SCOTUS already ruled previously that it was OK to transfer.”

Last July (2019) the Supreme Court just ruled that lower courts could not immediately prohibit the use of that money, before making a final decision on the merits (it being an officially declared National Emergency and all). Now that lower court has finally issued a decision. It will be appealed.

They are already building barrier with the 2019 MILCON money, and should continue to do so, until the Supreme Court finally ends up ruling.

The money came from the defense budget, and the border wall is a VITAL part of the nation’s defense.

Chief INjustice Dread Judge Roberts will vote as his democrat master will dictate.

I read somewhere that most of that money that went to Iran was their assets that had been frozen by us.
