Although I agree with the intent of the court’s action, should this decision be in the bailiwick of the legislature rather than the judiciary? Just asking for a friend of course.

True. It’s also quite telling that this country’s judiciary, which is charged with protecting the rights of citizens through the Constitution, never seemed to have a problem with it...

Long term, the legislature will need to fix it. Short term the SC Supreme Court May have authority under SC’s constitution.

“No-knock” entries are not supported by our Constitution. I wonder if any state’s Constitution actually allows them.

Encouraging that many here agree also and have not allowed the issue to become racialized or politicized. This is about freedom for all. And constitutional sanity.

Prayers for a renewed and restored sense of fairness, law, and order in this country. And smoother relations between cops and all communities.

The ONLY time a no knock warrant should be able to be used is if the place they are raiding has been under surveillance for more than 24 hours and they know EXACTLY what they are goign into and/or possibly have a “man on the inside”.

It should never be used at the drop of a hat for ANY residence, EVER!

Ironic that what brought on awareness of police abuses was the prevalence of video cameras.

That's why all the unions were so against them. It was sleight of hand when they were crying that "bodycams would make their job harder." Yeah, it will make coverups harder.

Whatever happened to the old-fashioned “stake out” where the occupants are arrested after having left the residence?

I suppose the cops don’t have the time for that anymore.

No. Ban no-knock warrants now. Figure out what, or even if, to replace them later - at leisure, with a full country-wide debate.

They can’t be bothered - they will surveill and surveill but they won’t do anything but watch.

Then they have the goon squad come in, no-knock the place, shoot up the general area - only to find out they have the wrong house or shot the wrong person.

I’ve posted this story a few times before, but it bears repeating:

A friend of mine lived in an area of Los Angeles that was near a notoriously high-crime sector of that city. To that end, he had reinforced his house and the entries thereof, to the point that his front entry was an armored “airlock” style double door chamber, much like those at a jewelry store. Except his had a 90 degree turn and didn’t allow enough room to swing a ram to open the second door.

About a year after he’d completed his modifications, one of the houses down the block became a meth lab/crack house. All the neighbors complained to the police about it. Eventually the police got around to raiding the place... but guess whose house they came to? Yup, my friend’s, because they couldn’t be bothered to read the house numbers properly.

I’m told the look on the SWAT members’ faces was priceless when they tried to ram the front door down and failed. They also tried to lob teargas in and effect entry through the windows when that failed; it didn’t work well through the polycarbonate sheeting he had instead of glass. He had a camera and intercom system installed, which the police didn’t bother to use. After he finally stopped laughing at their attempts and before they brought up some real equipment, he used his intercom to ask the police what they thought they were doing. They then claimed they had a warrant for this address. “Really? Hold it up to the camera and I’ll let you in if it’s valid.... Um, you might want to check the address on that, and then look at the number on the mailbox and painted on the curb.”

He never let them in, LAPD milled around for a while and then left.

I would call it a step beyond breaking and entering and describe it as an armed home invasion.

An issue very much on the minds of those who fought and laid down their lives against the British Empire in the late 18th Century.

All they need to do is remove all liability exemptions and (blanket immunity) watch how fast things change.
