Scott Peterson's death sentence in murder of pregnant wife overturned by California Supreme Court

The California Supreme Court on Monday overturned the death penalty sentence for Scott Peterson, convicted in the Christmas Eve murder of his pregnant wife, Laci, and their unborn son, Conner.

The court's decision came over 15 years after Laci, a Modesto, Calif., school teacher, was killed. Investigators said Peterson dumped his wife's body from his fishing boat into the San Francisco Bay in 2002. The bodies surfaced months later.

While the murder conviction against Peterson stayed in place, the court ordered a new penalty phase trial.

I am getting flashbacks of the terrible days when Rose Bird was chief justice of the California Supreme Court. This is sick.

Where is justice for Laci and Conner???

The law means only what judges twist it into, and what political DA’s decide to prosecute or ignore.

I always thought he was guilty, but I heard a rundown recently, and he probably should get a new trial.

OK, to be clear, his conviction was affirmed. Only his sentence was thrown out and remanded for a new penalty phase hearing.

If those were peremptory challenges then not seeing what the problem is.

The courts are in the process of abolishing the death penalty. Inch by inch, ruling by ruling, it is slowly going away.

Not endorsing it but clearly that’s what’s been happening.

I know. I am just saying I 110% believed he was guilty. But now hearing a lot more facts I didn't know, I am not so sure. But I heard enough to think he should get a new trial. Just overturning the death sentences was stupid, and it probably hurts his chance to get a new trial.

A lot of the things the media said about this case were not true.

Anyway, he's still a weirdo.

Trivia note: On the exact same day Peterson got the death penalty, two other, in separate trials in Californian got the death penalty. I wonder what their status is.

OK, that’s all new to me then. I thought his murder conviction was incontrovertible. I don’t think he’s getting a new trial.

Drew Walter Peterson (born January 5, 1954) is a retired Bolingbrook, Illinois, police sergeant who was convicted in 2012 for the murder of his third wife, Kathleen Savio, a few months after their 2003 divorce. Peterson first received national publicity in 2007 when his fourth wife, Stacy Ann Cales Peterson, disappeared. Although the police and Stacy Ann’s family suspect foul play, she has never been found.

Suspicions in Stacy Ann’s case were fueled in part by the death of Savio, whose bruised body was found in a dry bathtub in her home in 2004, with a large gash in her scalp.[1] Initially, Savio’s official cause of death was found to be accidental drowning.[2] In 2009, after the attention from Stacy Ann’s disappearance, Peterson was indicted for Savio’s murder after a second autopsy showed evidence of a struggle. He was convicted of the murder in 2012, and was sentenced to 38 years in prison on February 21, 2013.

And the judge did not allow some evidence he should have. Most the jury said they only convicted because of the tapes of his call to Amber Frey. He is not a likable person.

Where is justice for Laci and Conner???

Ironic that Connor's murder (2nd degree) is the enhancement which allowed the death penalty. In a state which supports abortion, though at Conner's "age" only for the life and health of the mother.
