"...It is perfectly ordinary and appropriate for the justices to write an opinion explaining the various reasons why they are rejecting Texas’ request. Indeed, the minority of justices who think that the court is required to accept original actions like Texas’ may well write short opinions of their own or note that they think the case was properly filed. So there is nothing overreaching if a majority of the court explains why the case is meritless."
"The justices’ decision whether to do that needs to account for this extraordinary, dangerous moment for our democracy. President Donald Trump, other supportive Republicans, and aligned commentators have firmly convinced many tens of millions of people that the 2020 presidential election was stolen. If that view continues to take hold, it threatens not only our national politics for the next four years but the public’s basic faith in elections of all types that are the foundations of our society."
"In a time that is so very deeply polarized, I cannot think of a person, group or institution other than the Supreme Court that could do better for the country right now. Supporters of the president who have been gaslighted into believing that there has been a multi-state conspiracy to steal the election recognize that the court is not a liberal institution. If the court will tell the truth, the country will listen."

Perfect analogy!
If the Texas suit is declared “meritless”, then doesn’t that set a prescedent that says states can ignore any or all of the US Constition? Can states then ignore the entire US Constition and then create their own?
What a load of rubbish.
The 74 million people who voted for President Trump, the overwhelming majority of who believe the elections are being stolen, have seen the irrevocable evidence of massive ballot fraud for themselves.
We don't need some idiot lawyer, popped up to his eyelids on cocaine, to tell us, we are not actually seeing what we are seeing.
If that view continues to take hold, it threatens not only our national politics for the next four years but the public's basic faith in elections of all types that are the foundations of our society.”
Funny how deranged Dem fanatics never talk about the dire consequences to our republic from massive, in your face ballot fraud.
Nothing threatens this Republic more than ballot fraud on this scale. It destroys the very foundation of this Republic and makes elections meaningless.
Smell that?
Smells like panic."

The Supreme Court already ruled in Trump’s favor in October when it denied a Wisconsin appeal on mail-in ballots. Gorsuch and Kavanaugh wrote about the unconstitutionality of the state legislature having been circumvented in that case, which is the basis of the Texas case.
You should have posted this. You summed up in 2 grafs what I blundered through 1000 words.
Goldstein needs to be writing for SCROTUMblog. It would be a much better fit.
The SCOTUS will not be dismissive, especially because so many states have signed on that they are approaching the number needed for CONSTITUTIONAL level actions.
“I did not come to this opinion because the President Trump or other conservatives fooled me; it is obvious from the known facts. I can think for myself.”
And Mr Goldberg, I have no doubt the view will continue to hold and I and 70,000,000 will view Biden and Harris as either attempted usurpers or usurpers, i.e. with loathing and contempt.
So we would have 8.1 justices?
Thanks Goldstein.
My faith in democratic institutions is just fine, Mr. Goldfinger. What I don’t have faith is in people in swing state blue dumps who attack these institutions with their fraudulent, just-barely-falling-under-plausible-deniability maneuvers.
So, feel free to look up the election of 1876, Mr. Goldfinger, and tell us what you find.

Nothing instills trust in a system like ignoring all violations of the rules and refusing adjudication of the issue.
This person is a highly trained moron.
When a person paid over a hundred thousand dollars for an education and it shows how poorly it was.
I read recently that it was 30%, but who knows, maybe more dems have signed on since then.
Ok. Still enough there to bury you Tommy boy!
This putz whore attorney would gleefully litigate any case if he had as much evidence as exists supporting the case for a “multi-state conspiracy”...as long as he got paid for it.
And he’s glaringly and deliberately ignorant as to the actual cause of action in the Texas case...which is NOT any “multi-state conspiracy” but instead is a deprivation of rights case that is clearly supported by black letter Constitutional law.
Baldfaced liar is more like it. Every liberal who says he/she thinks the election wasn’t rigged is knowingly lying and thus deserves no courtesy, cooperation help and aid of any kind.
