That law was enacted by his elected representatives. One does not change the law by fighting the police on the street. That would reject Rule of Law with Might-Makes-Right.

Or he died as a result of too many laws. Selling onesies is a crime? In America. Seems that if he had surrendered peacefully, he would have had the chance to argue that case in court. Would a jury really vote to convict someone of selling cigarettes one by one?

It was a crime because he was blocking the sidewalk and “setting up shop” in front of other stores who pay high rent to sell there. The shopowners were the ones who complained. Garner resisted arrest and had a heart attack. It should never have come to that, but it did.
