Worse than that, it looks to me like the defense is entitled to a directed verdict. I think the evidence is insufficient as a matter of law to support a verdict beyond a reasonable doubt as it is charged. Unless this judge has cajoles of steel, I don’t see him granting such a request.
Thanks for that, I now know that a Directed Verdict exists. I did not know that the judge can take over the fact-finding role of the jury when the evidence is so compelling that only one verdict can be given.
