Except for the group who assaulted the police, I believe the January 6th incident was truly a First Amendment protest. There were no firearms or explosives involved, many were obviously sight-seeing under the supervision of the police. The group which did act violently and confronted the police should be prosecuted - but not the others - a peaceful protest.
Consideration - he was paid thousands of dollars by CNN for his video and they gave him a friendly nationwide interview right afterwards. Query - what if he - a known BLM militant - contracted with CNN before 1/6?!?
