On 7 June, 2021, the Attorney General signed a “proposed rule” about the regulation of arm braces for pistols. The ATF has put the “proposed rule” on its website.
The “proposed rule” can be seen as a trial balloon. It has no legal authority, as it has not been officially published in the Federal Register. Once officially published, the public can make comments for 90 days once the proposed rule has been published.
Significantly, the Attorney General, Merrick Garland, signed this trial balloon, and not the acting head of the ATF.
The document arbitrarily states short-barreled rifles and shotguns are “dangerous and unusual”. Of course, all weapons are dangerous, otherwise, they would not be weapons. But all weapons are not unusual.
Banning short-barreled rifles and shotguns was not the intent of the law in 1934. The intent was to regulate “gangster weapons”.
Pistols were seen as subject to abuse. Sawed-off shotguns were seen as used by gangsters. Sawed-off rifles were added, virtually as an afterthought. This is why the overall length of 26 inches was included.
It makes no sense to consider short-barreled rifles as “dangerous and unusual” but to have pistols as constitutionally protected. The NRA lobbied congress to remove pistols from the law, which was done. Short barreled shotguns and rifles were left in as booby prizes for the Franklin Delano Roosevelt administration.

All it takes is for One State to Pass this exact same law,rule,regulation at the State Level and have it ONLY APPLY TO FEDERAL EMPLOYEE’s, then start Arresting and Prosecuting EVERY ATF, FBI and Federal Judge in the State, when they are facing 25 to Life for Gun Violations at the STATE LEVEL, the Rules will Change.
In most cases they are. Which is why we should eliminate the laws against short barreled rifles. I spend a lot of time at the range and I’ve never seen anyone shoot these other than from the shoulder. That we have to go through these regulatory mental gymnastics just to exercise our 2nd amendment rights is a travesty.
Mass non compliance. As part of this community, I can state unequivocally that there will be very little compliance. What’s more, many of the states will have our back. Think of it like pot laws. States won’t enforce BS fed laws.

Not saying the regulations make since, but it has been almost 80 years, they are not going away.

What’s the deal with the Auto Ordinance Thompson submachine gun replica? It is obviously semi-auto, and I assume they lengthened the barrel so it doesn’t fall under the short barrel rifle rule? But it seems to have a removable buttstock, as well, which I guess would just make it a long barreled pistol. Too many goofy rules for no good reason from what I can see.
What about them? The last I read, they were legal.
On handguns, manufacturers and U.S. military forces use terms different from those of Hollywood. Semi-automatic handguns are sometimes referred to as pistols (and sometimes automatic pistols in the past, see “ACP”), and revolvers are called revolvers.
I like the term, “pistola,” to refer to either (from some of the crazier westerns). ;D
Apparently they are legal. I just don’t understand the rules about putting a stock or arm brace on a pistol. Doesn’t make much sense to me, either.
