Yes. What this means is Giuiliani was intentionally misleading the court (with thousands of sworn affidavits, none of which has resulted in any witness being tried for perjury). Therefore his communication with a client (Trump) in this case is not priviledged. From NoLo:
“But, according to the crime-fraud exception to the privilege, a client’s communication to her attorney isn’t privileged if she made it with the intention of committing or covering up a crime or fraud.”
The actions are considered by this judge are fraudulent in nature, as if Giuiliani knew what he was saying was factually false. Therefore they can go after any communication regarding this case.
