I think it is also unAmerican to knowingly accept and rubber stamp seemingly fraudulent results as Pence did. Looking back it appears to me that Pence was there serving the swamp to sabotage President Trump beginning with the General Flynn firing thing and running through all the deep state leaking scum he had on his staff. He is pretty much typical GOPe slime in my eyes.

Which certificates is the President of the Senate to open?

“The Electors shall meet in their respective States, and vote by Ballot for two Persons, of whom one at least shall not be an Inhabitant of the same State with themselves. And they shall make a List of all the Persons voted for, and of the Number of Votes for each; which List they shall sign and certify, and transmit sealed to the Seat of the Government of the United States, directed to the President of the Senate.” – Article II, Section 1, Clause 3

Why did the Founders assign the job of opening the Certificates to the President of the Senate?

The Founders didn't have to mention this matter at all, or they could have assigned the task to the Clerk of the Senate or even to the mail-room clerk. Why, instead, did they assign in to the President of the Senate?

Because they did not intend the opening of the Certificates to be a mere ministerial task. The President of the Senate is an important position in the Constitutional scheme and he is given significant power. The reason the task of opening the Certificates is assigned to the President of the Senate is as a substantive guarantee that the Certificates are genuine and were prepared in conformance with Constitutional requirements.

Suppose just as the President of the Senate is entering the Senate chamber, a stranger is taking a stack of Certificates from the President's desk and leaves a different stack. Is the the President of the Senate supposed to say, “Oh. Okay, I'll open these. I have no Constitutional function other than as a mere letter-opener.”

Pence failed in his Constitutional duty.

I was the very first public supporter of Trump on this forum, even before his staircase descent and announcement.

Pence’s “fist bumping” had nothing to do with law. It shows only, by extrapolation, his biases.

Which are undeniable.

Did you imagine that power? Or are you saying the VP should have that power?

Is he really that dense or just trying to evade the subject? No one asked him to choose the American President, only to preside over a legal process, which required him to return the decision over to the contested states.

The states all had more than adequate time and legal justification to nullify their elections and name their electors in the legislature. All they had to say is the Governor and SoS did not follow state law! They didn’t even have to prove a scintilla of fraud.

They did not. Not even one.

Yet somehow this is Pence’s fault?


Absolutely it was in large part Pence’s fault. The state and national GOP played a sick game of political hot potato to run out the clock and steal the election from Trump.

Pence totally abdicated his duty as a sitting VP and leader of the GOP. Instead of hiding under his desk he should have been breathing down the necks of the state GOPers and making it clear political careers were being ended if they did not support the rule of law. He should have been on the hotline to the white shoe law firms refusing to support the GOP ticket and making it clear they would never work for the GOP/RNC again if they did not take the stolen election case. Etc., etc. Did he do any of that? No.

Pence was AWOL in a historic battle against Marxist Democrats who burn our cities. That’s the bottom line.

Anyone who believes Pence could have stopped, or even influenced the outcome is ignorant of the constitution.
So his constitutional obligation was to just rubber stamp the outcome...Got it.

Pence is talking about the election far more now than he ever did when he was VP and it mattered. I find that quite instructive. Pence operated in the background and did little but obstruct POTUS and the MAGA agenda. In 4 years as VP can he claim a single political victory? I can’t recall anything.

I'd be willing to be instructed if you would cite to some passage, say from the Debates on the Constitution, or the Federalist Papers, or the Anti-Federalist Papers, for the proposition that the opening of the Certificates is a mere ministerial task.

Also, do you think the President of the Senate should docilely open whatever documents are put in front of him, by whomever can manage to get them there?

What is your view as to why the Framers assigned this task to the President of the Senate?

But it was Republican legislatures that abdicated their legal responsibility and authority.

The President of the Senate is the vice president, and the only significant power he or she has is to break ties in the Senate. And open the electoral votes.

If that is true then why doesn't the Constitution give that task the the Chief Justice of the Supreme Court? What gives the vice president the power to decide which certificates are genuine, much less whether they conform to the Constitutional requirements?

The certificates are kept in secure storage when they are delivered and are not brought in to the House Chamber until after the vice president and members of Congress are there. No chance for a switcheroo.

The legislatures abdicated because there was no political price to be paid for doing that. You can thank GOPers like Mike Pence for that.

The GOP is the wholly owned subsidiary of the Chamber of Chinese Commerce. They wanted Trump gone and the GOP delivered for them. It’s that simple.
