It works the same on asset forfeiture

They glom everything ....even assets not in question

So when you can no longer operate your business you’ll give up the funds in question and some of the “legal” funds funds too jus to pay payroll etc

Used to be they had to have a conviction ...or at least go to a judge to obtain a freeze.

Now any LEO can call a bank in some states and ask bank accounts frozen

Cops and DAs know how to extort money this way....unless feds are involved assets forfeited stay local....if a fed task force....Feds get 20% which they simply kick to general fund

Locals and state csn use your money for trucks, guns, web gear, crime symposium junkets to Italy and so on

A racket it is...license to steal as my lawyer put it

The only purpose of these charges it to get people to flip on Trump. Even if they get off, the legal bills will ruin them. The DA is offering for all to be forgotten if they just give some dirt on Trump.

The only goal is for Trump to be in jail by 2024, and unable to run again for office.

Anyone have any idea why there are two sets of books? I read an article that suggested one set for the tax man, the other for the loan officer. Could this all fall on the CFO? No one thinks Trump’s name would be on any of this?

On a far, far smaller scale, my personal experience with the IRS: I was sent a notice that I had erred in my tax return and owed them a low four figures amount. I told this to a friend, who was ex-IRS, now a private accountant. He looked at my return, put a letter together and asked me to write a check to the IRS for a low three figures amount. The letter was total BS, but very professional. He explained: the guy whose desk this lands on will have a choice: cash the check and be done or fight for the higher amount. It’s not worth his time to fight for it. They cashed the check.

This is exactly why no one is enraged by all the Chicago murders. For the large part, the people getting murdered are themselves criminals or interacting with the criminal element; buying drugs, etc. The same is true with other criminal operations. If those operations frequently intersected with soccer moms and white collar joggers, then they would be quickly hunted down and put out of business. The criminals know this.

In the last year or so, criminals have been interacting with ordinary people more frequently, usually in black on white crime...mostly attacks. This is because our politicians and the media have essentially given the criminals their operating orders. That will be difficult to shut down because some DA’s are not prosecuting. We may be headed for a general breakdown.

The first problem with the indictment is that counts 2 and 3 are completely charges that Weisenberg failed to pay his proper FEDERAL income taxes for 15 years. NY can not bring a charge of a federal “crime”. This must be brought by the IRS, the agency with the authority to bring federal tax fraud charges.

Next, the indictment claims that the Trump organization is responsible Weisenberg’s supposed failure to claim NYC as his official residence. One, I do not believe that NYS can argue a NYC tax fraud. I believe NYC must bring their own case. Second, a person that owns NY home outside of NYC and is living in an apartment leased by his company is not domiciled in NYC, he is just staying close to his work for the convenience of his employer. Once he sold his house he then started paying NYC income taxes. Living in a leased apartment during the week that is paid for by the company is the same as staying in a hotel room rented by his employer. This is a benefit to the company to have a senior employee close by so that company meeting can be held in the late evenings or work can be done late into the night without the employee being concerned about the need to leave early enough to get home for meals and rest.

There are many other issues with the indictment and I would love to have a lawyer break it down count by count. IANAL so this has only been my take.

Counts 2 and 3 will, most likely, will be dismissed at the prelim. The NYC counts should also be dismissed at the prelim since NYC is the entity that needs to pursue fraud against them. The counts concerning the rent, vehicles and Christmas money for parties will most likely get dropped because they, arguably, can be explained by a strict reading of the tax codes involved, (need an attorney to explain these for me).

The Trump org, (and most likely Weisenberg’s lawyers), will show that the best accountants and tax lawyers were the preparers of the taxes and the Trump org and Weisenberg relied upon their expertise for their tax filings.

That’s what irks these people. They know he’s clean compared to all of them. No elected Democrat, and for that matter many elected Republicans too, would survive even a day of the kind of scrutiny that President Trump got over four years.
