If you do something wantonly dangerous right at a specific person, it’s not depraved indifference, so not 3rd degree.
If you do something wantonly dangerous, not knowing someone is around to get hurt, but someone is, and it kills them, that’s depraved indifference, so it is 3rd degree.
So if Noor had shot his gun straight up, and the bullet came down and hit Damond in the top of her head and killed her, that would’ve been 3rd degree. But since he was more or less shooting at her, in Minnesota, that’s not 3rd degree.
