LOS ANGELES - It happened on New Year’s Day 2014. James Tubbs walked into a woman’s restroom at Denny’s in Palmdale and hid in a stall. When a 10-year-old girl walked in by herself, he grabbed her and sexually molested her.
"The assault went on until someone walked into the restroom and scared him off. He fled from the restaurant, and he went unidentified for several years until a cold DNA hit identified him as someone who was arrested in the state of Idaho," said LA County Deputy District Attorney John McKinney.
During his time on the run, McKinney says Tubbs amassed a lengthy criminal record that included assaults with deadly weapons and convictions. In 2019, Tubbs was brought back to Los Angeles for prosecution on the sexual assault of the 10-year-old girl.
Despite his criminal background and the sexual assault, which Tubbs admitted, he may end up serving very little time if any at all.
While Tubbs is now 25, at the time of the assault, he was 17 just a few days shy of his 18th birthday.
LA County District Attorney George Gascón has a policy of not charging anyone under 18 as an adult.
"What is happening is our district attorney is ushering him right out the door, back onto the streets of this county and God knows where else he might roam. It’s madness, it makes a mockery of our criminal justice system," says McKinney.
Lt. Richard Ruiz with the LA County Sheriff’s Special Victims Unit, the same unit that investigated the Tubbs case, says his department is outraged.
"I would ask the public to reach out to Mr. Gascón and express their concerns and their outrage on a matter such as this involving a sexual predator," says Ruiz.
FOX 11 News asked the LA County District Attorney’s office why this case wouldn’t be transferred to adult court. That question was not answered. Instead, the following statement was issued: "The defendant entered an open plea to the court, leaving it up to the judge to decide what the sentence should be. Our office is seeking that he be placed in a custodial setting in a sheriff’s facility for two years."
McKinney says, "The DA is trying to distance himself from this result and lay blame on the judge when in fact, it's only happened because of his policy against transferring juvenile cases to adult court. Two years is a pathetic outcome for man who is a career criminal with felony convictions in multiple states and who committed forcible sexual assault on a 10-year-old girl in a Denny's bathroom."

2 Appear In Federal Court In Fatal Shooting Of Off-Duty LAPD Officer.
Two reputed gang members facing federal racketeering charges stemming from the fatal shooting of a 27-year-old off-duty Los Angeles Police Department officer appeared in federal court Friday and were ordered to remain jailed without bond. Jesse "Skinny Jack" Contreras, 34, and Luis Alfredo "Lil J" De La Rosa Rios, 29, were scheduled to be arraigned Feb. 3, with a very tentative Jan. 28 date set for a preliminary hearing.
Two other defendants in the case — reputed gang member Ernesto "Gonzo" Cisneros, 22, and Rios' 18-year-old girlfriend Haylee Marie Grisham — did not appear in court Friday. Grisham is expected to make an initial appearance Tuesday, but an appearance date has not been set for Cisneros, who is believed to have been wounded in an exchange of gunfire in the Monday night confrontation that killed Officer Fernando Arroyos. Los Angeles County Sheriff Alex Villanueva said Thursday night he directed detectives to take the case to the U.S. Attorney's Office because of his opposition to District Attorney George Gascon's decision to no longer pursue sentencing enhancements in gang cases. The Los Angeles Police Protective League issued a statement Friday applauding the sheriff's decision to seek federal prosecution, calling the U.S. Attorney's actions "a complete repudiation of the dangerous policies and heartless treatment of crime victims exhibited by" the district attorney. Craig Lally, president of the LAPPL, said that during a time when Los Angeles is experiencing a 15-year high in homicides and 54% increase in shootings since 2019, Gascon "should be prosecuting these murderers to the fullest extent of the law. (He) simply doesn't have the courage or conviction to hold soulless murdering thugs accountable."

Y’know what’s missing from this article? As disgusting as it already is, there’s more. The molester, James Tubbs, has declared himself to be a transgender “woman” named Hannah. The judge is hesitant to send him to the pokey because he/she might be teased by the other (cisgender) inmates.

If you place him in strict solitary confinement (for his own protection), he could serve a sentence of any appropriate length as an adult. In fact, you could probably build a secure little house on Sheriff property to house him for a fraction of the cost of his incarceration at a state penitentiary.
He’s already whack in the head, so lack of social interaction shouldn’t be a problem. If he goes nuts or dies in the little box, no one’s gonna miss him.
I’m in Florida, so if this happens, it’s not me.
The plot of the Charles Bronson movie, “Death Wish” was a man who was trying to bring justice to the world that had been abandoned by the government. I can see someone starting to kill people who have gotten off with little or no punishment. (Hillar Clinton is too well-guarded.)
As an author, I’ve thought this one through. The problem is an average person doesn’t have the resources to find and dispatch these people. The possibility of a mistake is also very high. (Just saying, for those of you who might take this as an idea.)

She may very well have some family members who will do just that.
Similar to one of the cases in the BOSCH detective series. A long and involved investigation of a cold case identifies the brutal murderer—and then the DA releases him because he was underage at the time of the killing.
Some people just need killin’. Chi-mo’s and the people who allow them freedom, are two of those.
